Hi, i am new here. I'm not sure that this is the right place to post this, if not sorry!
i recently moved to Las Vegas and was confronted with the HUGE drug testing movement here. EVERYONE has to go for drug testing for ANY job. (banking to Jack in the Box, there is not getting around it.) So I submitted a required hair test against my will. Being as I had never heard of it, I looked it up online and read of HUGE false positive rates, and other scary facts that could affect my financial future. Scared, I bought a hair cleaning product. It worked beautifully. My question is this though. Now that I've taken the preemployment test, do I have to keep allowing them to test me any old time? I don't have enough hair for that. I have to say, the girl that gave me the form to take the test had thinnish hair, and they took a HUGE patch right off the top of her head. she had spiky hair growing back in and it was bad. They took 6 patches from the top of my hair, and I cried that night I felt so violated. How can this be legal? I feel bad about doing the test in the first place, but feeling the missing hair made it so much worse. Do I have any right to request only urine, or only taking hair from the BACk of my head instead of right on the noticable top?. Please help. Thanks.

wow. that is so f'ing terrible... i've heard of hair testing but i figured they only took like a little bit... in no way should anyone have the right to do that to you... why can't they just have you piss in a cup or stick you with a needle? do they all do hair testing out there or is your company just crazy?
hehe most companies won't hire you unless you look *good* to the public...

my tests ( yea, tests) were about child custody. the first test was a standard test. court ordered. when i get to the facility i find a letter from the other attorney directing the facility to find marijuana, oxy contin and to go back a minimum of 1 year. i went ballistic as the court order did not specify this. after reasoning with the staff for about 1.5 hr the standard test was performed. it seems that they felt obligated to do the 1 year test because the other attorney was paying! after i offered to pay for the test to ensure that the court order was followed they saw the light.

so we go to court again and the attorney wants another test because i "refused" the test, oh and the facility made a mistake. i'm thinking he is a good client of theirs. so i had to do another test. on underarm hair. remember it grows .3mm per day. trim, trim trim. worry more. pay attorney more $.

1) If you do some checking, you'll find these tests (at least for MJ) are unreliable after 3 months.

2) I was unaware attorney letters carry any power, other than the threat of legal action to get a court order (which do carry enforcement power).

You were being baited so as to give the "other" side ammo.

Excuse me, but if they didn't hold you down to take the sample or get it by court order it wasn't against your will. You might not have wanted to do it, but you decided that it would be worth it in order to get a job. It was your decision.


Only if you want to keep your job. You can refuse to take the test at any time and they can dismiss you for it.

You can request anything you want. Whether or not your employers accede to your request is up to them. They might not want to do a urine test because it doesn't measure use over as long a period of time as a hair test. I don't see any reason why they wouldn't take the hair from wherever you want because it doesn't make any difference in how the test comes out.

Newsflash: They still don't have to hire you and they probably wouldn't having seen that you've gone out of your way to avoid a drug test.
