Don't know if this is state-dependent.

But as far as I know, the only trouble you can get into with MJ is for possession/trafficking/intent to buy (looking at Buzzby's thread).

Can you get into legal trouble being high?

Some states have public intoxication laws that cover being high on drugs, including marijuana..........;)

  3. I always thought that being high, was referred to as "internal possession" and was still illegal...

In Ohio the judges use urine screens to test for drug usage and yes, if it comes up positive, you can be charged with possesion. They don't use it too much for herb. Around here it's mostly for off-topics.

It seems to be fucked up but it is called possesion. I've never heard of "possesion by consumption". The judge explains it as, " You had to possess it to get it into your body, so you are guilty of possesion."

With herb it's no big deal, (Unless your on probation. Then it sucks) but we have had a bad meth problem and if you drop a dirty urine for it, your bond is going to be 70,000 dollars and there is the presumption of mandatory jail time for you possesing it.

    It's not funny then.........:wth:

SD does have an "internal possession" law, which can be, bur rarely is, used for marijuana. Howqever, if its discovered you are high on ANY substance, you can be charged with "being under the influence of an intoxicant other than alcohol" and THAT charge is handed out on a regular basis
