| New state law starts today June 30 2008 | News-Press.Com | Nic Corbett Starting today, a new state law will bring harsher penalties for marijuana growers. Under the new Florida law, a “grow house” will be classified as a building containing 25 or more marijuana plants. Before, the threshold was 300 plants. Growing that many plants is a second-degree felony. “Our laws were way out of date on that,” Florida Attorney General Bill McCollum told the Tallahassee Democrat. The law also allows law-enforcement agencies to dispose of grow house equipment after taking pictures or recording video. Tallahassee police say that in the past, they have had to store every marijuana single plant and piece of equipment until the people arrested went to trial. “The storage is expensive, and we spend a lot of time packaging the material, time we could be investigating other criminal activity,” said David McCranie, spokesman for the Tallahassee Police Department. Also, it will be a third-degree felony for someone to own, lease or rent a place while knowing that it is being used for drug trafficking or making drugs. <snip>

| The "number of plants" that constitutes illegal activity has significantly decreased under this new proposed FL Law. So, for a cultivator of the seed, I'd be best keeping my number of kush below 25 plants. Interesting and Noteworthy that even the po po themselves said : " we're wasting time on these cases when we could be out preventing [viz.] and solving Real crimes." Sheeseh----what a waste of time, $$, and carbons--daym!

| Whereas we would all like to see no penalties at all, this makes any sort of commercial growing a more serious matter. I wouldn't need 150 plants to meet the needs of myself and any of my friends that were so inclined. If Prohibition boils down to money, and I am sure that it is, this might lessen the number of those seeking to make a lot, and we all know, a real lot of untaxed money. |

| Wow, Florida is moving towards a bigger and brighter future, isn't it? Next they'll be building suburbs on all nature to prevent possible future marijuana growing sites. |

| Yeah, it seems they are always making screwed up decisions in this state. I swear, I've never seen anything like it. I liked Indiana a lot better.

| The change from 300 plants to 25 plants doesn't seem that significant when you realize that possession of more than 20 grams of marijuana is already a felony in Florida. You'd be in the deep shit if you were caught growing one plant! As for the amount, 25 plants should be enough to keep anyone in weed. At the rate I consume it, one 25-plant grow would produce enough weed to last me 12 years.

| You all are saying that a "lot of untaxed money" is gained by Cultivators; which is true--but the question we always talk about at NormL meetings is: how to implement a Revenue Tax on Cannabis? That is the appropriate tax amount? But the flipside of this is how will Cultivators be financially able to cultivate--the cost is high and profit margin moderate at best. |
