Vt. Medical Marijuana Registrant Busted
10/8/2008|WCAX News|Kristin Carlson

Glenn Myer uses marijuana to relieve his pain following a 2006 skiing accident where he spirally fractured his arm. It was almost amputated, but doctors saved it.

"So it's a very serious injury," Myer explained.

In 2007 he signed up for the Vermont Marijuana Registry. Initially it was only for people with MS, cancer, HIV, or AIDS. But the legislature expanded the registry two years ago over strong objections from law enforcement that worried it would be abused. It now allows people with any severe pain or nausea to grow pot. 107 people have signed up.

"I almost always use it every night," Myer said.

Myer ran into trouble at the end of last month when someone walking by his property in Morrisville spotted pot plants. Police seized 27 plants-- well over the 9 allowed under the registry. Plus, they were outside. Under the registry, plants can only be grown inside.

Investigators say just as someone was calling police to say they found pot growing on the land in Morrisville, police were already in Stowe at the restaurant Glenn Myer runs and owns. He had actually called them over a completely separate dispute. And it was there that police found more pot growing inside.

"He was starting the marijuana plants in the restaurant," said Ptl. Jason Luneau, of the Morristown Police Dept.

Police say they took 19 plants at the restaurant and then checked Myer's home in Waterville where 9 more plants were found. They also took over 3 pounds of processed pot-- the registry only allows 2 ounces. Morristown police say it's a big bust. All together it could have an estimated street value of $100,000.

"Well 55 plants and 3.95 pounds of processed marijuana-- it's a significant amount of marijuana especially for one person to use," Luneau explained. "At this point there is no indication that Mr. Myer was dealing the drug, but the investigation is continuing at this time."

Asked if he was dealing pot, Myer replied, "Absolutely not."

Not only does Glenn Myer face felony charges for cultivation and possession of marijuana, but so does his wife Claudine Myer. She is listed on the Marijuana Registry as a caregiver.

Myer gave police consent to search his home, land and restaurant. He claims the plants on his land are not his. Myer also disputes the number of plants and pot police say they took-- saying several of the plants they counted were dead.

"I don't know if the policeman thought they had found a great ring of marijuana growers and had this great bust to look so grandiose. In essence, all he did was bust someone who was trying to live a normal life with marijuana," Myer said.

A battle that could be decided in court.

It's inevitable that people in medical marijuana programs will fuck up. People are stupid. But every time one of these fuckups makes it into the news it hurts the possibility of passing medical marijuana laws that will benefit those of us living in currently non-medical marijuana states.

I wish that people would have more consideration for those of us who actually need medical marijuana instead of being selfish bastards.

Do you really think this guy was greedy? Or do you think he just unlucky? Sometimes it's easier just to grow a lot at once so you don't have to do it for a long time....

I guess we'll have to keep our eye on this case.

I think he was greedy and I think he was growing for sale. There were simply too many plants to seriously accept that it was being grown for personal consumption. Is there any doubt? Sure. Is there reasonable doubt? I don't think so.

If I was on the jury and not going for jury nullification, knowing what I know now I'd vote for a conviction.

I'd for conviction, This is why the marijuana system isn't tolerated, is because is because people who are granted permission, some of them tend to take advantage.

And whos the dumbass cop who estimated 3.95 pounds of marijuana was a street value of 100,000$

The registry allows 9 plants, But only 2 ounces of marijuana.

What the hell? Theres so many flaws in this goverment marijuana situation.

Why do cops always have extremely unreasonable estimates.. Why don't they get there teenage kids to come estimate it, Im sure they'd do a better job.

Damn, so there is no way to prove it either way, but the guy is charged with distribution anyway.....

I guess he did have 74 plants, and a few extra pounds. That is a lot of weed. I wonder if under Vermont law he might have been a caretaker for other patients? It didn't mention in the article but it did say his wife was registered as a caregiver with the Medical marijuana registry.

Also, I wonder why under Vermont MMJ Law you can only grow inside.

Simple. Growing inside makes it inaccessible to people who shouldn't have it. It also has much less of a tendency to upset your neighbors.

Maybe he liked the looks and smell of marijuana in his backyard?
Marijuana is a beautiful plant after all. If it were legal for me, I would grow tons of plants in the back yard, just because of the looks. There aint no way I would be able to harvest all of those sexy plants.
