Default 50 grams of pot: A "quantity" for "dealing"

Franklin teen-ager accused of dealing drugs
By DAILY JOURNAL | Feb. 18, 2004
letters@thejournalnet.com

A Franklin man who police say is a medium-level drug dealer was arrested Saturday after police reportedly found cocaine and marijuana in his house.

Dustin Robert King, 19, was arrested on several charges, including Class A felony cocaine dealing. He remained in the county jail Tuesday on $55,000 bond.

In recent weeks, Franklin police had fielded numerous complaints about King dealing drugs out of his home at 3080 Dowden Drive. The complaints described heavy foot traffic: people coming and going at all hours of the night for short visits. Detectives got a search warrant and went to King’s home Saturday night.

In the house, police reportedly found 3.5 grams (1/8 ounce) of cocaine and about 50 grams (1.76 ounces) of marijuana. The drugs had a street value in the hundreds of dollars.

They also reportedly found plastic sandwich bags and scales consistent with packaging drugs for individual re-sale, as well as hollowed-out cigars or “blunts” that would be re-filled with marijuana for smoking.

Detective Brian Goldfarb said King appears to be a medium-level dealer.

[b]“With that much quantity, he certainly had quite a bit of business, I would say,” Goldfarb said. /[b]

King, who has no prior record as an adult, was arrested on preliminary charges of dealing in cocaine, dealing in marijuana, reckless possession of paraphernalia and possession of alcohol by a minor.

The Class A felony cocaine charge is by far the most serious count: A conviction is punishable by 20 to 50 years in prison.

Goldfarb is seeking arrest warrants for two other men in connection with the investigation on charges similar to King’s.

Default Drug Dealing

Is 19 years on the planet really enough time to gain enough wisdom not to do something as stupid as this? Shall we brand him a felon, incarcerate him, release him later in life only to toss him onto the heap of wasted human potential?

It's saddening to see such wastes of humanity. The part that kills me is the amount of drugs. Mid-level drug dealer seems harsh.

How many people out there split 1/4 pounds amoungst themselves to lower the cost of consumption? Does that make you a drug dealer or a consumer?

An eight ball aint nothing, I'm sure Dubya could testify to that. So, if you don't get caught, it's OK to be President, but if you do, your a felon, which essential effectively nuetors the person from having the tools for a sucsessful life.

This kind of hypocracy stinks, and is pervasive even among drug consumers. It never seems like a big deal until it's YOUR butt on the line, or a loved one's.

The point being, there has got to be a better way to handle this insanity. What would LOVE do?

Dealer ought to be redifined to mean something else. Are there any clearly recognized profits to dealing? Does this young man own a home or an expensive auto? Does he have a job?

Petty drug dealing shouldn't carry life long consequences. In many states, there is no difference between this type of dealer and the guy moving 5 lbs or more of weed a week, at a substantial profit.

The definition of insanity is doing the same things over and over again and expecting a different result...

They got a search warrant only on that? Then... what's the maximum amount of people allowed to enter and/or leave your own home in any given period? 4 a minute? 6? Maybe they'll be nice and allow me 10 without getting put under suspicion..

Thumbs down Off with his head

I can't condone the coke nor do I have any real knowledg about it.

If he is selling weed then he was pretty low in his stash for a " Mid level dealer" My personal stash is bigger than that.

There is no sence in the sentancing for these offenses, if other "crimes" were judged with this stringently we would be choppin off fingers for shoplifting.

Well, in my opinion, if your smart and you are dealing you will keep your stash low just incase there is a bust, and just keep buying from a larger source as needed.
Its also smart not to keep your baggies/weed/scales together.

I dunno. I got busted once, had a box of baggies and two scales...but only an eighth of weed. Cops found $300 in my wallet, too...still only charged with possession.

The dealing charge won't stick; the quantity was way too low.
