Default Marijuana fire murder charges are dismissed

PHILADELPHIA - A judge threw out murder charges Tuesday against a man whose basement marijuana-growing equipment overheated and started a blaze that killed two firefighters.

Judge Teresa Deni said prosecutors had not shown that Daniel Brough, 35, was acting with malice when he set up high-powered lights and fans to help grow the plants.

The judge ordered Brough to face a trial on numerous other charges, including involuntary manslaughter, marijuana possession and causing a catastrophe.

A tangle of wires caught fire in August at Brough's rowhouse. The firefighters were found unconscious in the basement.

Plains' Note: I could have sworn we had posted the original article when charges were brought. I must be brain dead, 'cause I couldn't find it for the life of me. If somebody finds it, please post a link and I'll merge this one with it as an update.

Default Judge Deni showed some signs of sanity...some

Well, its promising that Judge Deni threw out the murder charges, but I'm a bit worried about the involuntary manslaughter and causing a catastrophe charges. I'm no lawyer, but maybe somebody can help me out here. Is it standard to charge a person with involuntary manslaughter if an accidental fire in their home accidentally kills anybody? Or just if it kills a firefighter? If it is, thats fine. But if they are going to charge the man with involuntary manslaughter just because the equipment he was using to grow marijuana caused the fire then I feel its rather ridiculous. It wasnt the marijuana that started the fire, it was perfectly legal equipment.

I'm sure it wasnt intentional because what grower wants to see his pride and joy go up in smoke....prematurely....peace.

Default a tangle of wires

The reason that the charge of involentary man slaughter was brough may be because the judge believes the defendant was negligent. "A tangle of wires caught fire..." If he did not exercise reasonable care setting up his grow room and started a fire...

To answer your question, smoking joe lee, I have not had the honor of talking to xxdr. zombiexx yet. This is, I think, my third day to be a member of this great site.

I'm looking forward to talking to all of you, even my most hardcore opponents. Let me say this though: the last thing I want is an argument about politics unless it has to do with our nation's War on Drugs. In which case, I will most likely completely agree with xxdr. zombiexx. I just state the fact that I'm a Republican pothead because I think its funny, a bit ironic, and helpful in showing people that not all Republicans are unreasonably conservative.

I dont even want to lable people as my "opponents". On this site, we should all stick up for each other. Especially if you live in America. We have an entire generation of disillusioned youth that are against us. The last thing we need is division among ourselves. peace
