| Fifth-grade Lenape student faces marijuana charges February 5, 2005 | pittsburghlive.com | By Michael Miller State police have not decided whether an 11-year-old boy will face charges after he allegedly brought a plastic bag containing what his principal said was "minuscule marijuana residue" to Lenape Elementary School last month. Tpr. Richard Fennell said the boy was released into the custody of his parents after bringing the plastic bag to school Jan. 12. Police did not make the incident public until they issued a press release Friday. According to Lenape Principal Tom Dinga, the fifth-grade student had the bag in his pocket and showed it to a classmate during class time. The classmate told a teacher, who informed Dinga. "There was such a minimal amount of residue that without the student drawing attention to the baggie, at a glance, it looked empty," Dinga said. "To say there were drugs in the school is a misnomer." He said the plastic bag had "minuscule specks of residue" in it and nothing more. The student will face out-of-school suspension, according to school officials. Fennell said District Attorney Scott Andreassi would decide on whether the boy will be charged criminally for possessing the marijuana. He said he was investigating where the boy got the plastic bag.

| He still brought drugs to school knowing what it was. Elementary school isnt the time to flash that stuff anyways, especially with D.A.R.E. Even your best friend might rat on you because it will "ruin your life". |

| When I was in 3rd grade (1978) my teacher (with on Glass eye who taught us to sing the National Anthem in German..go figure) freaked out when I was passing out rolling papers. I bought them at the store because they came with matches (ooh fire, fun fun ), and was passing them around as cool note paper. :-) Funny thing is, our school bathroom used toilet paper that looks just like rolling paper, only better for removing rust from metal than for wiping ones rear. Back on topic, if they press charges against this kid they will just set him up to be a criminal for life. Stupid policies. |

| if they press charges against this kid they will just set him up to be a criminal for life my thoughts exactly, I'm not saying it was okay for the kid to bring pot to school, however I do not agree with the possibility of criminal charges. At 11, the shools ramifications should be sufficient punishment. |

| Chances are slim that he will face any criminal charges. If his family gets a lawyer, you can be damn sure that he stresses that a criminal charge will ruin this kids life. It is sad that this even made it to a press release. It should have been handled quietly with a short, 2 or 3 day suspension for violating school rules. In Illinois, posession of ANY amount within a certain distance from a school is a CLASS X felony. If they throw the book at this kid, it would be an enormous travesty of justice, possibly the worst in history. Kids make mistakes. Don't make them pay for the rest of their lives. |

| an 11 year old can be tried for criminal offences???? anyways, you can get your record cleaned when you turn 18 i was told. |
