Default IDN: Corby loses heart as prosecutors demand life

Corby loses heart as prosecutors demand life
May 8, 2005 | smh.com.au | By Matthew Moore

Indonesian prosecutors made a final appeal to judges to convict Schapelle Corby and sentence her to jail for life, insisting marijuana in her luggage was hers because it was in her bag.

In a hearing that lasted just 20 minutes, prosecutor Ni Wayan Sinaryati rejected Corby's arguments last week that they should have fingerprinted the plastic bags containing 4.1 kilograms of marijuana and should have accepted more evidence from Corby's witnesses.

"We stick to our sentencing request and don't need to respond to the defence statement and the statement provided by Schapelle Leigh Corby," she said.

The defence "emotionally used words or expressions that were unkind and full of cynicism and even accused us, as well as officers of the customs and police, of violating the law", prosecutors said.

"The marijuana which was within the boogie board bag is legally and convincingly found to belong to the defendant."

There was no need to fingerprint the marijuana, Ms Sinaryati said, because Corby had already admitted it was in her luggage and the claim tag, customs declaration form and passport confirmed the bag was hers. This was enough for a conviction.

For most of the hearing, Corby gazed at chief prosecutor Ida Bagus Wiswantanu, who kept his head down and studiously avoided catching her eye.

Prosecutors urged judges to ignore evidence from two of Corby's travelling companions and her brother as their relationships with her should disqualify their testimony.

Evidence from an Australian baggage handler and a former Australian policeman was also dismissed because they had not seen or heard what happened.

The prosecution's uncompromising position prompted Corby's lawyer, Lily Lubis, to immediately begin canvassing an appeal - even though a decision is weeks away and she insists she remains hopeful. "This is only the first court," Ms Lubis said after the hearing. "We still have the second court, the High Court and the Supreme Court."

Corby clasped her hands as if in prayer when she arrived at the court and ignored questions about the knife attack in a Melbourne jail on John Ford, the Victorian prisoner who gave evidence that a convicted drug dealer owned the marijuana found in Corby's bag.

Ford was placed in solitary confinement after he was twice attacked in jail, his lawyer said. Ford, 40, had not reported the razor attack him on Wednesday of last week, his barrister, Tom Danos, told the Victorian County Court yesterday.

Ms Lubis spoke with Corby before the hearing and said she was shaking and was looking "more down, down down".

The defence will make its final remarks next Thursday, before judges deliver their verdict, likely on May 26 or a week earlier.

this case is just making me sick to my stomach. the uncompromising stance of the Indonesian court is just unfathomable. Basically, they have the right to completely disregard any defense to the charges, and have used that right at every opprotunity. AS much as people hate US drug policy, I would much rather face trial here than in any number of foreign courts. My prayers go out to Chappelle, and I hope things turn around for her, as no one should suffer a life imprisonment for a marijuana charge. In a world where convicted child molesters, rapists and murderers are turned loose to walk our streets, no one should be sentenced to life for possession of 10 pounds of plant material.

The Indonesians are probably responding as they feel the American Government sympathies direct.

Angry I am sick...

Like violently ill on account of this injustice that the Indonesia sem hellbent to purpetrate.

Am I the only person in the world that thinks this is spiteful? Second question: should lawyers be so explicity spiteful.

More evidence of spite... not to mention shoddy police work.

They're railroading the poor girl. It makes me puke. Excuse me.
