Denver Voters Could Have Chance To Legalize Marijuana

Denver voters this November may be asked whether to make the use of marijuana legal in some instances.

The Committee for Safer Alternative for Enjoyable Recreation (SAFER) said it has submitted the necessary 5,383 signatures from at least 5 percent of Denver city and county registered voters to get its proposal placed on the ballot.

SAFER said the Denver Election Commission has determined that it appears to have sufficient valid signatures. The petition now goes to the City Council for approval and placement on the ballot. The council may act on the matter as early as next week.

SAFER proposes that Denver legalize possession of 1 ounce or less of marijuana by anyone 21 or older.

But even if the ballot measure passes, the city attorney's office says a state law outlawing marijuana possession as a Class 2 petty offense, punishable by a fine of up to $100, still would apply in Denver.

So this law would apply only to the greater Denver area, I assume. So would the local cops be required to enforce the state mandates?

Unfortunately, I feel that it will meet the same fate as state medicinal marijuana in the U.S.; federal law supercedes it and they can still prosecute. So I guess state and federal law would kind of overpower the municipal law. And wouldn't it just be sort of a bylaw since it's municipal. Sorry if I sound ignorant, Canada has a different legal system of course. What I do know however, is that it has to happen on the national level, but every little nudge certainly doesn't hurt!

How can we oppose the Schedule status of the drug? That I think is where changes will take place.

I used to live in the Denver area and all I could ever see coming from this is possibly a reduction in overall arrests by Denver police for those 21+ caught with "personal use" amounts (Oz. or less).
Other cops would still make arrests and issue the $100 ticket they do now......which isn't too bad of punishment compared to other states for the same amount of weed.
Still......Denver SUX, IMO. Can do without that town.

Local LE does not have to enforce federal laws. The federal government doesn't have the resources to arrest and prosecute people holding an ounce or less. Technically, they can have DEA agents looking for such people, but it occurs vanishingly rarely.

In Colorado you don't get arrested for an ounce or less. It's a class 2 petty offense, like a parking ticket.
