This is a tragedy that never should have happened.
The tragedy occurred because, apparently, the police didn't follow procedure and announce themselves.

Sending the SWAT team made sense from the PD's POV. They were going after a suspect who they had reason to believe was armed. The way to deal with an armed opponent is to be overwhelmingly better armed and armored. Usually that defuses the situation because the suspect realizes he hasn't got a chance. If it doesn't defuse the situation the SWAT officers are better prepared and protected than ordinary uniformed officers.

Making it through your shift alive is the "Prime Directive".

I've listened to witness statements long enough to know that people are usually not terribly reliable, particularly in situation where they are being somewhat overwhelmed by what they are seeing.

We try to video our warrant services or at least audio tape them, which would refute claims like this. I'll be interested in seeing if they did something similar and haven't revealed it yet.

That's a practice that makes a lot of sense. If they have such a tape, can you think of a reason why they'd be keeping it under wraps if it exonerates the officers? The ongoing bad press can't be much fun for the department or the city.

The not hearing thing isn't too reliable to me. I'm not calling anyone a liar or saying anyone is necessarily wrong, but my experience makes me too skeptical.

It depends on their review process. If the agency is considering this an internal investigation, this statute may apply:

112.533 (4)

4) Any person who is a participant in an internal investigation, including the complainant, the subject of the investigation and the subject's legal counsel or a representative of his or her choice, the investigator conducting the investigation, and any witnesses in the investigation, who willfully discloses any information obtained pursuant to the agency's investigation, including, but not limited to, the identity of the officer under investigation, the nature of the questions asked, information revealed, or documents furnished in connection with a confidential internal investigation of an agency, before such complaint, document, action, or proceeding becomes a public record as provided in this section commits a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083. However, this subsection does not limit a law enforcement or correctional officer's ability to gain access to information under paragraph (2)(a). Additionally, a sheriff, police chief, or other head of a law enforcement agency, or his or her designee, is not precluded by this section from acknowledging the existence of a complaint and the fact that an investigation is underway.


I'm not sure how their policy is written or if they are applying it, but it is a possibility.

If i was a drug dealer sleeping at 6:15 in the morning and suddenly my door busts open, i would panic thinking it was some fool tryin to rob me, and if i had a gun i would without a doubt pull it out.

Its a shame that a man had to die for owning (or selling) herbs which god made for us.
