HAMILTON -- Three people face charges after a scuffle with police at Hamilton's marijuana cafe.

Two officers in uniform entered Up in Smoke yesterday and noticed a patron smoking marijuana in a pipe. The officers tried to arrest the man, but two other patrons allegedly stepped in and assaulted police.

Police said one of the patrons ended up on the ground and bit the curb, egging on officers to step on his head.

No one was injured, but one man was charged with simple possession and another man with obstructing police and creating a disturbance.

A woman was charged with assaulting police and obstructing police.

I'm shocked! Didn't these officers know that they weren't supposed to enforce the marijuana laws?

well, it IS canada after all.....they seem to have a habit of turning their back on illegal activity

Funny how you use sarcasm when the police knew people were smoking up there since it started and didn't enforce the law yesterday or the day before or the day before that. Maybe police officers are allowed to just pick and choose at there own descretion. At least thats how it seems.

That's exactly how it works. We are constantly receiving reports about people who were caught in possession and were let go with nothing more than their weed being confiscated. That's great!

The sarcasm was because some of our Canadian compatriots have been putting forth the idea that because laws aren't always enforced that they are no longer the laws.

The most powerful aspect of the judicial system is the police officer.. they alone posesses the power of "selective and descretionary enforcement".

That's not true at all.

Grand juries can choose to indict or not.

District attorneys can decide whether or not to prosecute and what charges to make.

Juries can decide whether or not to convict and can choose not to because they don't think the laws are just.

Except where there are mandatory minimums, judges can determine punishments for those who are convicted.

None of the ABOVE would even play any part in the picture though.....IF it were NOT for the involvement of police officers in the first place.
The above-mentioned are all involved in the prosecution/conviction/sentencing process or aquital......but it IS the police officer who HAS the power to make or NOT make the ARREST!
Hence.....the POWER of police and their discretion.
