| Convicted In Pot Case, Man Loses His Home To Crown Petti Fong | The Globe and Mail | 08/24/2005 VANCOUVER -- A homeowner who pleaded guilty to growing marijuana in his house has become the first person in British Columbia to see his home forcibly taken by the federal government. Van My Luu, of Langley, was arrested in 2003 at his home on 268th Street after a police investigation. Mr. Luu was the legal owner of the home and controlled the grow operation, police said. He pleaded guilty to the production offences but challenged having to forfeit his home. Mr. Luu's lawyer, Jay Solomon, argued in Surrey Provincial Court that seizure of the house was an inordinate sanction relative to the offence. Mr. Luu was given a one-year sentence. But Shannon Gerrie, lawyer for the Department of Justice, argued that Mr. Luu had a sophisticated operation in his house and was actively involved in the production of marijuana. Judge Dennis Devitt ordered the house handed over to the Crown. Under the guidelines, the property will be disposed of by the Minister of Public Works. "We're hoping this will be a deterrent for homeowners who let grow operations take place in their homes and hope they will think twice before setting up these operations," Corporal Diane Blain of the Langley RCMP said of the seizure of Luu's home. This is the first time in British Columbia that the courts have forcibly taken property from someone who was convicted of a criminal act. Two years ago, the Crown seized a home used as a grow operation. There have since been a number of other forfeitures, but Cpl. Blain said all the other homeowners consented to the proceedings. Mr. Luu's house will now be sold, and, after the home's mortgage is paid off, the remaining money will be directed to the federal government.

He's the small kid on the playground. That's why he loses his home. Because the cannabis community doesn't have the will or wherewithal to be his backup. The bully is beating on our friend. The bully says he has the teacher in his back pocket. When are we gonna stand up to the ****ing bully?

It's funny, I don't see laws enabling the government to take the house of people that use it to produce child porn, and to me, that's an exponentially worse crime. No, instead they target the marijuana growers. Also, this is I believe just a municipality as of now, I don't think this is even BC wide. Might be if there's not enough resistance to this. Is there anywhere in the U.S. that does this?

| That was written very well. I like that comment. I completely agree. And the nintendo part was awesome. It's too bad. Well, at least most people still care, right? Just maybe not enough to do anything about it. That's like when my girlfriend comes home and says her boss was being a dumb *****. She invests emotion in wanting to stand up to her, but she won't because she doesn't want to risk her job. I guess that's why I reall respect people who will risk more than I'm willing to. Others, suggest risk is unnecessary. I hope they're right, and I don't. I do, because it would be nice I don't, because all the risk that has been contributed will have been in vain, and I hate that thought.![]() |

I don't agree with people losing their houses for growing pot, but it's illegal and was this guy a commercial grower? It never said how many plants he had. If he was then they probably figure the guy is making payments with drug money. If it was a small amount and for personal use that's just bullsh*t. In our country the U.S they will take someones house just for having 1 pot plant. In this case i just say it's just another excuse for the government to use to take someones property. In reality i doubt people are buying houses or cars from growing a few plants With commercial growers that's a different story. |
