Girls Arrested for Pretending Parsley was Pot

Two 10-year-old Florida girls were arrested and suspended from school for bringing a bag of parsley to school and telling classmates it was marijuana, the Daytona Beach News-Journal reported Nov. 29.

The students at Old Kings Elementary School in Palm Coast were called in by school officials who learned that they were showing the bag to other students. The girls said they were pulling a prank, but were arrested, taken to the Flagler County Inmate Facility, and charged under a state law that makes it illegal to claim any substance is an illicit drug.

The girls were later released to their parents but were suspended from school and will have to attend drug-awareness classes.

If we don't punish the ten year olds now then soon the nine year olds will be playing make believe too. Is that how you want your kids to grow up?

How do you even charge a ten year old? I was under the impression that until your twelve you can't be charged with a crime. Maybe thats only where I live or maybe I imagined it. I remember a news article in my local paper once complaining about orginized crime rings using 11 year olds to steal cars because they couldn't be charged.

You want the kids to learn, but yet you suspend them from school. That makes alot of sense. I think they should be told of the severity of bringing marijuana or claimig to have marijuana in school, could be. I don't think the cops should have ever been contacted on this matter. Except to tell this to the kids.

There's no way these kids are going to be prosecuted. The whole police/arrest thing was a tactic to scare the crap out of them, their friends, and their parents. I hope they are convinced of the severity of their "offense".

From now on they'll be sure to keep anything to do with marijuana very secret.

Geez, you would have thought they would have at least picked Oregano . .that is probably the closest to seeming like the real thing.

Ten year olds don't know that though...by the time they're 12 and smoking MJ, they'll be bringing in oregano to sell to classmates in order to fund their MJ habit.

At least these children will now KNOW what pot looks like -- they have to go to Drug Awareness Classes.

The program will probably teach them all kinds of propaganda about marijuana. Some years from now they might try it anyway because i'm going to assume everyone knows atleast one person who has smoked pot before. They will realize they were lied to after one of their friends smokes some straight pot and is fine(but stoned) so then they might decide to try it, then they will move on to hard drugs which they weren't lied to about and get a real addiction. They are shutting down DARE programs across the country because it doesn't work, what good is this program going to do!

It's stupid that they are even making them take the awareness course for just joking around about parsley. If whoever told on them really thought it was pot then i think they might need a drug awareness class themself. In fact everyone who thought it was pot deserves to take the program, it doesn't make much sense that they are making the 2 girls take it and not the rest of the class who actually believed that it was weed. Every kid probably went home that day finding parsley in their house and accusing their parents of having marijuana

Just to give you some background on the law being used...........

It was created mainly for dealers (crack and coke) that were selling bags of powdered sugar or chunks of soap and claiming they were drugs.........then using the defense that there was no drug when they got arrested.

But I've never seen the law applied to someone not selling (or offering to sell) a faux drug.
