| That's why they had to send in the National Guard: federal law supersedes state law but it's up to the federal government to enforce it. |

| I can pretty much guarantee that the states aren't going to feel the same way about marijuana as the southern states felt about civil rights. This is a slam dunk for the states. They'll just say in court that they were enforcing the state marijuana laws and they supercede the local laws. And if that fails, they'll just say they were enforcing the federal laws. Its really a no win situation for those poor souls in Denver who decide to fight their arrests and possible convictions. Oh well. |

| I don't know why you have all these pessimistic attitudes in advance of the evidence. The situation you describe hasn't happened with Denver and it hasn't happened with medical marijuana, which would fit into exactly the same scenario. State and local cops are following state medical marijuana laws. Why couldn't Denver police be required to follow Denver pot laws? As I've said repeatedly, no one knows how this is going to turn out. Mr. Footer has a team of lawyers who think they have a case. You, for some reason, discount that possibility. |
