| Medical Marijuana Activist Forced to Leave Country Shannon Kari | The Globe and Mail | 01/24/06 Vancouver -- The Canada Border Services Agency has informed medical marijuana activist Steve Kubby and his family that they must leave the country by Thursday, or face a forcible removal. Mr. Kubby, his wife Michele and their two daughters were informed of the deadline yesterday in a fax sent to their home in Sun Peaks. Last Friday, Mr. Justice Yvon Pinard of the Federal Court of Canada turned down a request by the family for an emergency stay of the removal order. Mr. Kubby, 59, suffers from a rare form of adrenal cancer and has used marijuana for a number of years to control his condition. He faces a jail sentence of at least 120 days in northern California as a result of a 2001 conviction for possessing a small amount of mescaline and psilocin. Mr. Kubby said yesterday that he is prepared to fly to San Francisco on Thursday and surrender to authorities. "I have always complied with the law. I am tired of being intimidated because I am using medical cannabis to say alive. If it comes down to having a big face-off in California, then bring it on," he said. Mr. Kubby said his wife will travel separately with their children, so their daughters will not have to see him taken into custody if he is arrested upon

| I was in the court room listening to Steve's rendition of manna at his cannabis/mushroom trial and wondered if the jury would believe that crap about mushrooms as manna. I figured as I went to lunch with his Lawyers that that argument wouldn't fly. We ate at the County cafeteria. Its hard to get a jury with lots of false information from a D.A. and a defendant with a disease that sounds horrible and then see a perfectly healthy speciman with a defense argument as bent as the charges by the prosceution to believe either. They let him go on the Cannabis but found him guilty on the silliysibin mushroom stem. WHY? His argument was that the mushroom was manna from heaven that those bible characters recieved in a delirious moment in god history from heaven. He was in possession only as a education item and not for consumption. I believe him..not the manna story.....but the jury didn't and I think he offended some by bringing in religion....he was reaching. If he'd said that he also dablled in psychotropics as a personal experiment it still would not matter. The fact is Steve got caught with something other than Cannabis while the warrant was searching for marijuana. HIS BIG MISTAKE He was running for govenor and he knew they were watching him. He's lucky his relationship with the S.F.Cannabis Club wasn't examined closer or the FEDS would have had him and Dennis for lunch. Come on back Steve and get it over with and try to get something positive going here with your wonderful family....hell man we'll make it better for ya...come on home. We can put tons of visitors on your list that can bug the jailers and I think the law allows you your medicine in jail its the jailers that can't smoke on the job. You should be allowed your medicine while in the slammer. You need Taxi?

I don't think he'll get his marijuana in jail. The jailhouse doctor will have to determine that. | |

| "I have always complied with the law." Not true or you would have completed your sentence and appealed your conviction. |
