| Cops: He Admitted Smoking Marijuana Martina Brendel | Jersey Journal | 01/27/2006 A West New York man was arrested yesterday on the Hudson-Bergen Light Rail in Bayonne after he admitted to police that he was stoned, reports said. Alexis Rodriguez, 23, a 60th Street resident, was riding the train northbound from the 22nd Street station at 12:41 a.m. when police asked to see his ticket, reports said. As Rodriguez showed it to them, cops detected the smell of marijuana on his breath and noticed that his eyes were bloodshot, police said. Asked if he was high, Rodriguez said he had just smoked some marijuana at a friend's house, police said. Rodriguez was arrested and brought to headquarters, where a computer search revealed he had an outstanding warrant in state Superior Court in Jersey City for $2,700 and one out of Guttenberg for $250, reports said. | Hmm, I recall hearing from several people that as long as you aren't in possesion of anything (paraphenalia, weed, etc.) that you would be fine. Meaning you could get completely baked, get on a train, walk up to the nearest cop and tell them to their face that you are completely stoned *I realize this is an incredibly stupid thing to do, trying to make a point though* and if they then proceeded to search you and you came up clean they couldn't do a damn thing. That atleast seems to be the general consensus that Im hearing. Public Intoxication is what I thought would be what could be enforced, but really unless your causing any trouble or acting crazy I doubt the cops would actually do anything. |

| In SD, injestion of marijuana, or "an intoxicant other than alcohol" is a class one misd. You can also be charged for posession if the police prove you have a drug in your system through a blood or urine test, so yes, even being high is enough to get you arrested in some areas. Listening to the "general consensus isn't nearly as accurate as checking the laws in your area. While what you've heard may hold up in some areas, in others, telling a cop you're high could land you in jail if they somehow PROVE it. The way the law is applied most often in SD is that it is used on probationers or parolees....they can be forced to submit to urine testing at any time, and a positive result not only is recorded as a parole/probation violation, but as a new offense as well. |
