| Kubby Takes Marijuana Request To Court Elizabeth Hume | Sacramento Bee | 02/03/2006 Medical marijuana activist Steven Wynn Kubby is expected back in Placer Superior Court today for a hearing on his request to use edible cannabis while he serves a 120-day jail sentence for a drug conviction in 2000. Kubby's attorney made the request Tuesday, claiming his client will die unless he is allowed to use marijuana to treat his rare form of cancer. The attorney, Mike McPike of Fresno County, also asked for home detention with an electronic device to monitor Kubby's movements. The home detention would be served in Marin County at Kubby's new residence. The 59-year-old activist returned to California Jan. 26 after being deported from Canada where he's lived since 2001.
