Police Say Woman Arrested After Calling To Buy Marijuana
AP | Grand Forks Herald | 02/11/2006

WEST FARGO, N.D. - Police were surprised to get a call early Saturday from a woman seeking to buy marijuana.

"A young lady called the West Fargo Police Department and asked the dispatcher if he knew where there was marijuana," Officer Ken Zeeb said.

The dispatcher told her it was illegal, but she insisted, and police then told her they had some in the evidence locker, Zeeb said. The 20-year-old Fargo woman showed up at police headquarters a short time later, and gave the dispatcher $3 to buy pot, he said.

She was arrested on charges of criminal attempt and possession of drug paraphernalia.

"She seemed to be very coherent and aware of what she was doing when I spoke to her. She did not appear to be under the influence of alcohol or drugs or anything like that," Zeeb said.

"I've heard of some crazy things happening. A lot of times, you just think to yourself, 'I don't think this one can be topped,' and then something like this happens," the officer said.

Besides the possession of paraphanalia thing (I guess she even broght a pipe so she could smoke it at the station?) I think its rediciulous that you can arrest someone when they haven't committed a crime. She paid $3 for nothing in return, how is she a threat to society? Sounds like it was just a prank, but even so she didn't really do anything "wrong".

Soliciting to purchase illegal drugs is a crime.

That's how a lot of police stings work: they set up phony dealers to sell phony drugs. When people come to buy them they get busted.

I know its a crime in the US, I didn't mean I thought it wasn't against the law, I just don't personally think its a crime unless drugs were actually purchased. Like, if a guy says "hey man, I'll give you some weed for $5" and you agree and give him five bucks and he arrests you (undercover cop) what were you really being arrested for? Giving someone $5? To me it just seems like something from Minority Report. Unless we're talking about the sale of weapons or something I don't really support arresting people until they've actually done something damaging to society. This woman damaged society how, by giving a cop $3?

Guess what? personal beliefs about the law mean absolutely nothing in the courtroom. Believe what you will, but the laws are black and white. Good luck trying to convince the judge your personal vision of what the laws SHOULD be are what he/she should sentence you by.

Whats your point? I never said my personal views would actually have an effect on the law had I done something like this...I thought what happened was unfair so I explained my opinion.

My point is anyone dumb enough to blatantly break the law in such a stupid manner DESERVES to get punished. I'm not in favor of marijuana-related arrests, but I make exceptions for people that show zero brain activity. Anyone dumb enough to do something like that desrves to be arrested for something, and just being a moron isn't against the law. I feel anything but sorrow for their situation.

Why should people be put in jail just because they're dumb (if this wasn't just an intentional prank by a bored person)? People who aren't real smart or don't have a lot of common sense don't deserve life and liberty? I mean, yeah, growing pot within 50 yards of a police precinct is one thing, but here someone exchanged $3 for something they didn't even get to see, and got arrested. How is that protecting me and the rest of society?

How is arresting someone for growing, selling, possessing, or using marijuana protecting society? All marijuana laws are bullsh*t. I'm curious as to why you think arresting someone for soliciting to purchase marijuana should not be punished while you seem to think those other things should be punished.

I'm not a legal expert, but I believe that would be entrapment.
ENTRAPMENT - A person is 'entrapped' when he is induced or persuaded by law enforcement officers or their agents to commit a crime that he had no previous intent to commit; and the law as a matter of policy forbids conviction in such a case.
