Court rules against Pine Ridge hemp growing

An American Indian treaty and United States law do not allow for the cultivation of industrial hemp on the Pine Ridge Indian Reservation, a federal appeals court ruled Wednesday.

Alex White Plume, vice president of the Oglala Sioux Tribe, and members of his family planted hemp on their property but it was cut down and confiscated by federal agents.

Industrial hemp is related to marijuana and is used to make rope and other products. It has only a trace of the drug in marijuana, but it is illegal to grow hemp in the United States.

The 8th U.S. Circuit Court of Appeals said it empathized with the White Plumes but concluded their enterprise was illegal.

"We are not unmindful of the challenges faced by members of the Tribe to engage in sustainable farming on federal trust lands ... And we do not doubt that there are a countless number of beneficial products which utilize hemp in some fashion. Nor do we ignore the burdens imposed by a DEA (Drug Enforcement Agency) registration necessary to grow hemp legally," justices wrote.

"But these are policy arguments better suited for the congressional hearing room than the courtroom."

well, the feds have told them where to live, where to die, when the supreme court said the Chreokee had rights to the land in Georgia ole Andrew Jackson told the court to get their own army, and the "trail of tears" happened.

these judges couldnt let the natives get the idea in their head that they could grow whatever plants they wanted on their own land, I wish a tribe out west, in the 9th circuit courts jurisdiction would try the same thing, perhaps the result would be different.

And so the indians get beat up one more time by the federal government.
If indian land is sovereign land, then the indians should be able to grow whatever they wanted or what was concidered legal by the tribal government. BUT we all know that they really aren't sovereign, now don't we.

Cool What do we expect?

After the history we have with these people? They were herded up like animals, forced to stay on land that they didn't want, then told it's a nation of your own.

Oh wait tho, just so long as you don't do anything we disagree with..

The real problem is two dead FBI agents laying in the grass with their heads blown off on reservation land. These people will pay for that the rest of their existence.

You want to help these people then?

Then start voting the person, ask them their views BEFORE they get into office and boot them out if they lied.

That is how it will end up in the congressional venue.

However, we have to remember that Judges balance their questions against the constitution and precedent-
And the precedent was set over forty years back.

I hate to say it but the Indians got screwed because they were screwable. Basic nomads with no real claim (recognized by the rest of the world) to the land they lived on. But you know what?
