Medical marijuana groups claim DEA unfair

Larger California dispensaries of medical marijuana claim they are being unfairly targeted by the U.S. Drug Enforcement Agency.

Among them is Shon Squier, 34, of Hayward, Calif., whose major storefront operation was shut down last month by the DEA, which also froze bank accounts containing $1.5 million and confiscated several expensive cars, motorcycles and $200,000 in cash, the Los Angeles Times reported Monday.

Further down the street, a much smaller operation wasn`t touched, leading Squier to allege he is being unfairly targeted for being successful, the Times said.

California`s two medical marijuana laws, Proposition 215, approved by voters in 1996, and Senate Bill 420, passed in 2003, are not clear about how much money proprietors of the estimated 170 medical marijuana outlets in the state can make.

The DEA does not recognize California laws legalizing the sale of marijuana to patients with doctor`s prescriptions, and special agent Gordon Taylor said the businesses have nothing to do with compassion for the terminally ill.

'When you pull the mask off, you see that they are nothing more than common dope dealers,' Taylor told the Times.

This is why marijuana is illegal. Its a real easy way for the DEA to generate Extra income for their jobs. Ever see that mouse in a wheel ?

The DEA bust smokers and take their money so they can hire more DEA agents so they can bust more people ... so they can take their money ... so they can hire more agents .....

I still don't understand any of this...please will someone with a bit more legal savvy fill me in?
I understand that the DEA and the Fed do not recognize Proposition 215 or Senate Bill 420. What I don't understand is how this really plays out day to day...the dispensaries I'm sure are not difficult to find...what kind of protections are afforded to dispensaries by California when the DEA decides to bust one? Have their been any big legal cases involving the legality of California dispensaries when the feds bust them, in light of Prop 215 and Senate bill 420?

The DEA tends to bust dispensaries that are selling marijuana to people without legitimate medical recommendations and those operating on a grossly for-profit basis. It's bad press to bust legit dispensaries because it looks like they're bullying sick people, but if they can make the dispensary look bad then the public doesn't mind.

None. There is no provision under Prop 215 or Senate Bill 420 for dispensaries, only individual caregivers. Dispensaries started out as collectives owned and operated by patients and caregivers. Later, entrepreneurs started making fortunes off of them.

No. They aren't legal under state or federal law. The state LEOs have, for the most part, seen them as extensions of the caregiver concept and left them alone. The Feds look for opportunities to take them down when they can do so without raising too much public ire.
