Default TX: Woman gets 2 1/2 years for mailing marijuana to herself

Woman gets 2 1/2 years for mailing marijuana to herself
01.08.07|Chron.com

An Amarillo woman who mailed 78 pounds of marijuana to herself was sentenced to 2 1/2 years in federal prison today.

Tiffany Joy Kelly, 28, pleaded guilty in October to one count of illegal use of a communication facility, the U.S. Attorney's Office in Dallas said in a news release. She has been in custody since her arrest in July, after a postal inspector in El Paso became suspicious of two Express Mail parcels.

A search warrant allowed officials to open the packages, which were then resealed and sent to Kelly at a motel in Amarillo.

Kelly was arrested after accepting the packages. Prosecutors said she admitted buying the marijuana and mailing it to herself so she could distribute it.

Hmmm I would think going in your car and buying it and then driving home is a much better situation than trying to use the United States Post Office. Not that I think you should try to do anything with 78 lbs of , but one has to scratch his/her head over this one.

In this country, I think you do less time for stealing a car, than getting caught trying to distribute

ditto. 2 and a half years should be plenty of time for her to realize how careless that was.

Default i don't know about you, but

I don't know about you folks, but seeing as she was busted with 78 pounds and she is getting 2.5 years she can think of herself as a bit lucky. She even admitted to possession with intent to distribute of 78 pounds. When I was caught with 44 grams in Virginia they tried to give me 10 years.

Sad story though, one would think that an adult would have the right to send themselves plants after all.

Default seriously this is sad

where do you think your weed comes from? If you have ever bought weed odds are it was either illegally grown by someone in the USA, someone who risked being busted for 4 or 5 months, who risked having their farm taken if a helicopter went over. Or you smoked some weed that was smuggled over the border, perhaps by someone that walked 50 miles through mountains or desert, then someone else packs say 100 to 1000 pounds into a car or pickup truck and drives it to a big time dealer, who breaks it up into smaller allotments, then someone else takes a risk and drives out to buy 10 pounds from them, they perhaps sell 1 of these pounds to the dealer you know. Lots of risk is taken.

I know people that take the risk to grow, that have taken 50 pounds through the airport at a time(starting back in the 70's), dirven pickups full from Arizona to Missouri, Illionois and Florida, and I know folks who have, as recently as last year, successfully sent themselves a quarter pound by UPS, and who in the past used to receive a pound at a time from Washington state (back in the 80's when weed like that was at a premium in Chicago).

If you "thin the herd" too much who will be left to sell you your bag???

She takes the risk of having a dog possibly sniff the package during the mailing of the pot, i agree that she would have been better off to risk putting it in a car and driving it back. Getting 2 1/2 years for 78 pounds of pot isn't bad seeing that at one time getting caught for weed in Texas was a very serious crime.

A few nights ago i watched something on tv about drug smuggling. They interviewed ranchers that live in Texas near the Mexican border. They talked about the drug smuggling problem and how they are threatened to sell their land and keep their mouths shut so the smugglers from Mexico can continue to bring drugs into the U.S. Theres not enough border guards to stop all of them. They even mentioned that in Mexico people can bring drugs right up to the border without fear before going into our country because of the amount of corruption with Mexican officials. The only people that try to do anything about it is our side of the border. A few of the ranchers who have been threatend by the smugglers believe that our own government doesn't care about drugs and it's just a show they put on for the public when they make a bust and people get arrested and go to jail for drugs. When they get confronted about the problem of drugs going from Mexico into our country they don't say much about it. Some of the Mexicans take their money and build buisnesses within our country or some corporations have hired illegal Mexican immigrants to work for them because they will work for less than what us Americans will work for. Most of those drugs being brought in is cocaine. We harrass Colombia and spray their crops with toxic chemicals, but i don't see the federal government ordering our troops into Mexico to battle the drug cartels. If they catch anyone it's mostly the muels they catch walking over the border with back packs filled with drugs.

People like John Walters just make speeches about BC bud coming in from Canada and don't address the problem of what goes on at the Mexican border with harder drugs.

Marijuana should be the least of anyones concern. If it was legalized 78 pounds would be cheap and she wouldn't have much use for it because people would be able to get marijuana from a store.

The Mexican government just sent troops to Tijuana to stem drug cartel violence.

That would be an act of war, wouldn't it? We operate in Columbia with the approval of the Columbian government. Mostly we supply equipment to the Columbians to do the job themselves.

Oh, I agree that sending this particular plant to yourself through the mail shouldn't be illegal. Hell, I rate it right up there with the other plants/flowers I had delivered last summer.

But...

Since it is illegal and it is reeeeeaaaal easy to find out what the penalities are for doing it, to send yourself that many pounds in my mind borders on the criminally stupid...But that's just my opinion.

I agree she is lucky the sentence was so comparatively light.

As well, considering that the whistleblower reward for turning in someone for sending drugs through the mail is up to $50,000...I'd be very cautious when considering the pro's and con's of sending any to somebody else, too.

As to where to buy a bag? As easy as it is to grow this plant (been growing now for 5 years) I don't buy bags anymore. I think of the supply business the same as any agricultural business (well, except for the legality of course), it should be grown and distributed locally cutting down transport costs, security risks and maintain quality control (no more mexi brick weed), keeping the money local as well.

I took myself out of the whole corrupt loop though. Personal use grower. I know what I am smoking, how it was grown, harvested and cured and no middleman to fuck up the product.
