|  MT : Prosecutor adopts policy against misdemeanor marijuana arrests Prosecutor adopts policy against misdemeanor marijuana arrests 10/20/07|Montana News station CBS| Nearly a year ago, Missoula County voters supported an initiative asking law enforcement officers to make adult marijuana possession offenses their lowest priority. Now County Attorney Fred Van Valkenburg has put that into a draft policy. He says the county is asking law enforcement to stop arresting individuals or writing and submitting tickets where the offense committed is solely possession of marijuana in misdemeanor amounts, or possession of drug paraphernalia intended for the use of marijuana. Under the proposed policy, if a defendant is charged and has no criminal record of consequence, county attorneys will offer deferred prosecution. No court appearance would be required. John Masterson is chairman of a committee that is tracking marijuana arrests says Van Valkenburg's policy satisfies the committee's expectations of how county officials should be handling personal amounts of marijuana. |
