| OH: Homeowner in Deadly Fire Charged 4/18/08/ WKRC.com/ Staff Report A Marijuana.com News Update! A Colerain Township man faces a drug charge today, two weeks after a fire at his home took the lives of two Colerain Township firefighters. Matthew Cones faces a charge of cultivation of marijuana, the lowest-level felony in the state of Ohio. The maximum sentence Cones will serve if he's convicted is one year in jail. Prosecutors say Cones was growing five pot plants in his basement on Squirrels Nest Lane for personal use. The pot was discovered after the basement in the home caught fire two weeks ago today, on April 4th. Colerain Township firefighter Captain Robin Broxterman and firefighter Brian Schira died battling that blaze, when they fell through floorboards weakened by the flames. Prosecutors told Local 12 that Cones attorney arranged for Cones to be brought before a judge this morning for arraignment, before the indictment was released. This is a highly unusual move. In a news conference last week, Hamilton County Prosecutor Joe Deters said the growing of the pot was not directly related to the fire. The blaze began as an electrical short in a circulating fan in a cedar closet. That closet was in an area separate from where the marijuana was being grown. Cones and his wife Sharyn are horticulturalists who also grew orchids in their basement. Sharyn does not face any charges. ( Cedar closet? With a fan? Mr Cones must be rich, that would explain the irregular arraingment without incarceration. That would also explain why his face wasn't plastered all over the T.V. They have given him a "no publicity" exclusion for some reason........ I can bet money on this one. They need to show something for the cameras and grieving relatives of the firefighters, so they charge him with cultivation, a fifth degree felony, then their going to plea it down to a misdemeanor and have him pay a fine and the sentence will be suspended...... | The fire started in a cedar closet equipped with a fan??? Was that closet perhaps where the marijuana was dried??? You certainly wouldn't put orchids in that dry of an environment. Small consolation to the families of those firefighters. You would think if he was that well off, he could have afforded a competent electrician to wire in that fan... Two people died, and this guy will probably pay no more penalty than the rest of you who are busted with a single joint during a routine traffic stop. Edit: Apparently there was plant material in the cedar closet, the prosecutor said they tested the plant material remaining in the cedar closet and it test negative for marijuana.He also said that temperatures in and around the closet was about 1800 degrees farenheit. What dried plant will survive that ??? Apparently they were drying some kind of plant in the closet, the question is what?? Also, the fan was a oscillating type of fan, not hardwired into the electrical system of the house. it apparently shorted out and started the fire in the cedar closet. He also had an alarm system that automatically alerted the fire department. On second thought, it would be no different than if someone had a cedar sauna in their basement that caught fire due to faulty lighting system. Just a sad situation for the firefighters families.
