The other night I went to grab weed for my friends party, we all pitched together and had like $300 so I go to get it and as I'm pulling out a cop comes up to us and tells us the car smells like weed get the hell out. I decided just to hand it over cause they were going to search the car. Anyways I'm being charged with possession over 30 grams. I'm from Canada and I'm only 17 years old. I just wanna know what I should do/whats going to happen?

edit: forgot to say Ive never gone to court before, but i was caught 2 years ago with some weed and put on diversion.

i dont think there is much u can do seeing as the cop had probable cause to search. but maybe he had no right to pull u over in the first place since u didnt commit a crime. not shure tho

theres no way the car could have smelt like weed because we didnt even burn inside it either, but I did hand them the weed so i guess thats my own fault and can't do anything about it.

Since you been caught red handed you might as well be as non-awkward as possible I dont know the law so I researched it,

Cannabis is a schedule II drug in Canada for amounts larger than 3kg. Amounts smaller than 3kg are classified as Schedule VII, and smaller than 30g as Schedule VIII. It is generally tolerated in small amounts for most of Canada (3 grams). It is legal for medicinal use with a federal permit.

In my opinion being your first real time with any considerable amount I think you will get a caution and a fine or at a push a small jail time but you must establish it was for personal use.

I think they know it was for personal use because before I got searched I threw away my scale and a bunch of money which they never found. I told them that I was coming from a party and we all pitched together and had 330 bucks and they asked me how much weed it was, I said I wasn't sure and then they asked if it was over 30 grams and I said yes. I know it was 100 grams or a bit over. And the cop said that she was going to charge me just with possession instead of possession with intent.

also my dealer was there when it happend he handed over all his weed too, he had like 2 z's but we both tossed our scales and money and made up a story that we were buying off the same guy and he left before the cops came. So were both gettin possession over 30 grams. We both cooperated with the cops and when the cop drove me home she said that it would be unlikely that I would go to jail for this so I dunno. I dont want to go jail I'm only 17 turning 18 in a month and i know id get fucked up in jail

I really have no idea as to what the standards of probable cause are or search/seizure law in Canada - but I can say that I sincerely doubt you will go to jail.

Getting caught with an amount over 100 grams in the states would definitly send up red flags, but from what you wrote the police seemed to just brush it off as somewhat of a minor offense.

I will echo merry-juanas advice that you seek advice from a lawyer regarding the intricacies of the case.

you told them you and your friends all pitched together? and then you had it on you?? i think they are going to be looking at Intent to Distribute, to be honest.
