Default Urine testing for child custody all clean results

Hiya! I am not asking for advice on beating drug tests because I do not get high, "not that I have a problem with people who do" but I was wondering if anyone has ever been tested for drugs in a child custody and if so what was the outcome if the tests came back clean. My situation is I am guessing out of the ordinary and I am wondering if my civil rights are being violated. My husband accused me of doing drugs about 20 months ago in the state of Michigan and was seeking full custody of the children. The court ordered a hair test and urine testing right away and I passed them both with zero notice. I thought that would be the end of it but the judge keeps ordering me to take drug tests, even though I have never done drugs, admitted to their use or have failed any drug test. So far I have taken and this is a rough estimate, over 70 urine tests, 4 hair tests and about 40 swabs. No positives, zero, none, nada! Which I have had to pay for all of them. I am still taking weekly urine tests and mouth swab tests with the possibility of another hair test and I am due back in court in a month. I am guessing my ex husband has spent over 80 thousand dollars on his high priced lawyer. Also he has not had to take one drug test. I welcome any comments, thank you.

The drug testing forums have a lot of posters that had to take court ordered drug tests for custody suits.

Yours seems to be quite extreme. You have tested clean so many times that you would think the judge would get tired of all the bullshit and stop it.

If you have a lawyer, tell him to do his job and put an end to all this nonsense.

That is just horrible. How can they make you take that many tests at your own expense when you keep coming back clean. Can you sue your Ex to pay for all the tests. How about slander also? Is it legal to go before a judge and falsly accuse someone of criminal activity and have it proven false time and again. You need to write the ACLU maybe. What does your attorney say?

Well my lawyer says that the whole thing stinks of corruption and has never heard or seen anything like this. But yes we are going to try to sue for slander and for the costs of the drugs tests. You are the second person I have talked to that has mentioned the ACLU.

Actually I expected someone to say how it is all unbelievable, I personally think it sounds extremely unbelievable. Who would think that a person could be forced to take that many drug tests with zero positives. I am willing to bet most people who are actually convicted of a drug offense do not take that many drug tests.

i live in michigan and ive never heard of anything like this. making you pay for all those tests is bullshit. i know of somebody in michigan that took a drug test for a custody battle, failed the first drug test, got to keep her kid, and never had to take another test.

I've been convicted of a drug offense without EVER taking a piss test after the intial arrest/booking

I would say that after all of these passed tests, at the very least, the ball is in your court...he is only making himself seem like a manipulative, dishonest ass who is only out to spite you, and is not after the welfare of his children...good luck.

Your situation is totally unreasonable. What has your lawyer done to stop your being saddled with all of these unnecessary drug tests? Has he filed a formal complaint with the court? It sound like the judge is in collusion with your husband. I've never heard of such a thing before. Contacting the ACLU and an investigative reporter might be good ideas. These guys love to put the spotlight on corruption in the legal system.
