| Yea so two of my friends were hangin out, and the one driving stopped by his house for a second, but ended up falling asleep? yea i dont know how he managed to do that, but anyway, he basically left my other friend alone in His car. He had to be home, but the one that fell asleep wouldnt answer his phone. So my friend who was stuck in the car, called me up and asked me if I could bring him to his house and then bring the car back to my other friend (since I live near him). So we did that, but I had about 2 grams of bud on me, and we ended up getting pulled over and searched. Now whats the worst thing that can happen for 1st offense possesion of marijuana? |

| In 96% of the time you encounter this scenario--assuming you are a first time offender---you'll 1) lose your 2g to the cop who decides to keep it for him/herself, 2) appear in court to plea down to a simple for a misdeamoner charge, 3) suspend your drivers lic for 30 days, and 4) go to DUI class. The other 4% of the time--not sure.

| Most likely you will get TASC classes but it depends on the state. Don't hire an attorney it will be a waste of money for such a minor offense. Try PFJ and you may get off completely. |

From the OP it doesn't sound like an illegal search. Of course if there is way to avoid conviction he should hire an attorney. It will still cost more than the conviction though. | hey guys, I'm new to the forum. This might be a mild thread hijack, but I am basically interested in the same question that the OP has, except I would like specific info on New York State (which is where I am located). I never drive around with more than $20 worth of weed. I keep it behind a CD that is attached to the back cover of a hardcover textbook with a clear CD jacket (is that a good hiding spot?). I don't have a criminal record. The worst I have is a speeding ticket from 5 years ago. So I was wondering: a) what is the WORST that could happen? b) what is most likely to happen - what would most cops do if they find it? And I have a similar question about paraphernalia, since I smoke out of a miniature water bong (I can't handle hot smoke). Why would possession of paraphernalia be illegal if stores sell it in the open in Manhattan? Is there a distinction between paraphernalia that looks/smells like it was already used for marijuana, and paraphernalia that looks clean? Is there any penalty at all for the latter? What is the easiest way to entirely clean a mini pipe/bong? Where would be the best place to hide it in the car? If a cop finds a clean piece of paraphernalia, does that give him probable cause to search the entire vehicle? Any answers are much appreciated, folks. |
