I live in SC, where can i get this at? court house or where? any info would be nice. Would call them and ask but then they might do a commando raid on my house.

dont even bother buying it at all. you'd just be wasting your money. i believe you get them at the court house though. i bet you will be the only person they see trying to buy one.lol

definitely go for it then. the only thing is, you may want to do outside your own town if you live in a small town. you dont want a police officer walking through the building to remember your face.

Marijuana tax stamps are supposed to be purchased and affixed to your bag of weed. You buy stamps based on the amount of marijuana you currently possess. Basically, buying stamps is like telling the legal system, "hey, I've got drugs!"

The stamps are moot anyway, they probably aren't even sold anymore. Possession of marijuana - even with stamps attached - is not legal and having stamps attached will do nothing for you in court. Asking for stamps is, quite literally, asking for trouble.

yeah but if he doesnt have anything on him, and just wants the stamps for novelty, i see no harm in it. also, id be pissed if they wouldnt sell him the stamps. that would be them forcing you to break that law, which is known as entrapment. (at least thats how i see it)

i believe there was a major court case with timothy leary that involved marijuana tax and 5th amendment rights. i believe tim won.

That's the point though... if he doesn't have any weed on him, then they won't issue him a stamp. It's a *tax* stamp... it's meant to be a tax directly related to the amount of marijuana in question. This means you show up with your bag of weed, they weigh it, charge you the tax, give you a stamp, and then you're good to go.

In reality though, they'd have you pinned on the ground with their knee on your neck as soon as you pulled out the baggie in the court.

in the article it doesn't say i have to have them affix it but it does say

SECTION 12-21-6000. Violation is misdemeanor; imprisonment, fine, civil penalty. [SC ST SEC 12-21-6000]

(A) A dealer who violates this article must pay a penalty of one hundred percent of the tax in addition to the tax imposed by Section 12-21-5090. The penalty must be collected as part of the tax.

(B) In addition to the tax penalty imposed, a dealer distributing or possessing marijuana or controlled substances without affixing the appropriate stamps, labels, or other indicia is guilty of a misdemeanor and, upon conviction, must be imprisoned not more than five years or fined not more than ten thousand dollars, or both.

They wouldn't be forcing you to break the law. If you bought the weed on your own accord, you already broke it.

Entrapment is when a law enforcement officer basically forces or entices you to do something illegal that you would not otherwise do. The tax stamp laws are pretty much moot anyway. When you get into legal trouble related to marijuana, it's because you're in possession of a controlled substance, not because you didn't pay your marijuana taxes. That the state would not sell you stamps would in no way constitute entrapment unless you were barred from a legitimate attempt to purchase stamps and subsequently charged with violating the Marijuana Tax Stamp Act. However, that does not happen in this day and age; you'd be charged with possession under the Controlled Substances Act and any claim you made about trying to pay taxes would not be a viable legal defense (as Buzzby was eluding to).
