Okay so me and my friends have a dilemma. We want to go up to White Hen and get sum munchies but it's 1:07 AM and it's past curfew. But we're alll reaalllllyyyyy STOONNEEDD and we need to know if it's illegal to be high in Illinois, like just walking around high not causing mischief er anything.


Anybody know?????

As long as your not carrying anything it's not likely they will take it much farther than a few questions, that is, if you run into a cop. If it's past a legal curfew (not your parents), as your a minor, I'd advise you all to stay home -- maybe order a pizza. Meet the guy outside if you don't want your parents to know. Then again, you don't want to disobey your parents. The decisions yours, be safe.

It is NOT illegal. Only a few states have an "under the influence" law concerning marijuana. Illinois is not one of them.

Technically, in many states (including Connecticut), it is not illegal to simply be high so long as you are not driving (because then, in some states, you could get hit with a DWI/DUI -- though you did say you'd be walking). It is illegal to be in possession of marijuana, but once you've already smoked it, you're no longer in possession of anything illegal so you can't really get into trouble (assuming you don't have a pipe or anything else on you).

However, some states have things like "internal possession laws." (You've probably heard TM talk about them before, as they have them in his state.) "Internal possession" is basically the act of having drugs in your body, and if police have probable cause to get you to submit to a drug screening and they find something in your system, you can be charged with possession of whatever drugs they find in you. I know South Dakota has an internal possession law but, to be perfectly honest, I can't confirm or deny the existence of this particular type of law in other states except for my own, where we don't have it (thankfully...).

If you're out past a curfew set by your state and/or town, that's a whole new issue. If you're underage and you're out when you shouldn't be, you can get into trouble just for that. Being high while out past curfew probably wouldn't be to your advantage, but whether that actually results in any charges being brought against you would depend on the things I wrote above (meaning, whether you were driving, if you were in possession of anything, and if your state has an internal possession law).

All in all, if you're really stoned and you're worried about leaving, just stay home and make something. Then you don't have to spend any money on food, either.

I would strongly advise against breaking the curfew. I got busted this summer for breaking curfew, and it definitely sucks. Could have been much worse though, I was just glad I was not in possession at the time, any other night that week and I would have been really screwed.
