On Saturday me and 4 of my friends were park on the side of a street not doing any but waiting for a friend. They thought we were buying drugs. A cop passed us and shined his light in. He then turned around and got our I.D. After that he proceded to search me and my friends. I never heard them ask any of us if it was ok to search, they just went into our pockets. I was charged with possesion of drug paropalia and it was disorderly conduct. They found half a gram and three pipes between the five of us. Is what they did legal? I'm not sure what my fine is going to be because I have to call the judge in a few days. I am also a minor but three of my friends are over 18. Any replies would be greatly appeciated.

as far as i know that search was illegal

The cop first has to question you. if he thinks that you are suspicious, he can then ask to search you or your car or whatever. If you say no, he then has to have "probable cause" to search you. If your story is a complete account of what happened, then no, he could not legally search you.

Let's be a little fair about this.

I get paid the same amount per hour if I arrest someone for pot or write 2 parking tickets, so I don't think it really is going to "put my kids through college".

Judges are paid an annual salary and don't get bonuses for trying more cases, so actually, more arrests only mean more work for the same amount of money.

Prosecutors vary; some are paid an annual salary os this wouldn't apply to them either. Some get paid by the hours, so it might.

Who REALLY benefits the most?

DEFENSE Attorneys!!!!!!

If you don't get arrested, they don't get paid. If you don't fight, they don't get paid. They bill you for every minute that they are thinking about your case. If you actually added up the amount of hours billed by attorneys in busy firms, you'll find that the lawyer has figured out how to get more than 24 hours out of a day.

Everybody complains about the cops etc. making money off of the WoD, but one of the biggest, most direct beneficieries is YOUR attorney.

Niteshift, the thought that is out there is that if the war has app. 25% of the police departments time and resourses, then when the war ends we might less police.

You will still only work 8 hours in an 8 hour shift but there might be 85 officers to protect us from violent harm etc. instead of 100 officers to do that plus confront citizens for cannabis offenses and such.

There is the other trades that set up shop in the war. Prison investors et al., drug testing industry investors and their co horts.

The DEFENSE Attorneys are feeding their family on the drug war, as you indicate. Your profession makes it possable. With out a collection department involved, they have no customers. It also makes it hard to do fund raising w/o the customer.

I realize that it is difficult but we need to try to keep this on topic here folks. I will trust that future responses in this thread will be with that goal.
