I just got busted and have court on Monday. I had just pulled up to a parking space and was grabbing some weed when my friend told me a cop was coming up. I dropped my weed down the side of my seat and stood up. He never saw the weed. I was wearing a tight jacket and he said he saw the outline of a pipe in my pocket. I denied and he threatened to call the drug dog and arrest me. I gave him the pipe and then he asked for my weed. Which I then gave to him. I got a possession and paraphenalia charge. Did he have the right to ask me to give him the pipe. It didnt look like a weapon and I hadnt even smoked yet. Fuck idaho cops

The search was entirely legal. It would be wise when engaging in illegal activities to know your rights and employ that knowledge to protect yourself.

Just my penny but if the cop did not see the pipe and only said he saw a outline of a pipe in your coat you could have refused to hand it over. Since when is a pipe illegal? If he saw the pipe and saw resin in it then I think he would have been able to make the arrest. You handed the pipe and the marijuana over so the search was legal.

you should have just said it was a tobacco pipe and they are completely legal...then when he asked for the weed just say 'what weed?'

i dont think its right that they are allowed to do that..especially if he didn't actually see the pipe with resin from mj on it.

IS anyone else amused by this thread's title? He declares it an "illegal search" then goes into detail about how he gave up the contraband of his own free will, and then asks if the actions taken by the cop were legal. This is no way was an illegal search, and actually, no search took place whatsoever. A cop asking you to give him somehting is far from the legal definition of a search. This is one of many situations where the most basic understanding of one's rights could have been a lifesaver. Instead, we get the typical teenage response aka "I was illegallly searched! Fuck the police!! !!" when the poster doesn't even understand that he was never searched to begin with.
