If I just smoked a j and i have no more weed or paraphernalia on me but my car smells of mj and the cop searches me and finds nothing is he allowed to test for THC in my system? And is it different if I'm in a car or walking down the street?

I suppose it depends on where you live.

If being high from weed is considered being under the influence then he could charge you with DUI(notice how what influence isn't specified ).

Likewise on the street he could charge you with public intoxication.

So to be safe

yea if you live in the US you can be charged with public intoxication. and if your driving you can be charged with a DUI

usually tho they will not charge you with public intoxication plus they can only charge you with it if you are on public property.

the reason they dont charge ppl to offten tho is even if you have thc in your system it could be days or even weeks old and they have to prove that you were under the influence at the time of the arest.
