|  smoking in car Hey, just a quick question. I dont smoke alot, mostly during the summer one time a week. Well sometimes my friends go out and get some bud but then they want to smoke it in town somewhere just parked in random spots. I think its a stupid idea, but say we get caught, i'm never the one driving though. If we get caught and we had 3.5 grams on us (which is max we ever get) what would i get? |

| Depends on the state you live in. Check out Marijuana Policy Project's website I think they have state by state marijuana laws. In my state anything under 1 1/2 ozs is just a misdemeanor and results in a fine. Kinda like a speeding ticket.

| ahh alrigh thanks, it looks like 30 days and up to 500 dollar fine but would only one person get charged with possesion? someone i know got caught with it in the car, and only one got charged with possesion. |

| Pretty risky in a car type situation. Correct me if im wrong but I believe that as long as you have the keys on you and are in the car, and they can somehow prove your intoxicated, you can be charged with DUI (unless you arent the driver of course).
