LOL Niteshift....for once I find myself in total agreement with a LEO. No offense, it just doesnt happen all that often. I agree with you about a certain someone being a little hard headed. Question after employment

What about if you were hired for x amount of months and then they come to you and tell you to sign a random drug test form?

and then threten termination if you dont comply?

Companies have the right to change thier policies, and being that you are employed by them... If you want to keep your job you must obide by them. If after 6 months of working for them they decide that everyone has to wear a uniform, you'd have to do that... this is no different.

It's still a civil problem and doesn't have jack sh*t to do with the Constitution.

And yes, they can change policies. You have options. Your option is to go find a job somewhere else, just like if they changed the dress code to say you had to wear a pink dress and heels.

As far as federally regulated drug testing is concerned, the protection of many supercedes the perceived "rights" of a few.

How many of you want to see that school bus driver on crack?

How many of you want to be sitting at that intersection when that semi plows into 10 cars because the driver is passed out?

How many of you want to be riding on that commuter train when the switchman decides he needs to snort a line instead of watching his switches?

etc...etc...

As far as non-regulated testing (Non-DOT employer based testing), it isn't a "right" to work for anyone; anywhere.

If you don't agree with employer based drug testing, then work for someone who does not test. JC Penneys, for one, Day Cares, most nursing homes, resturaunts, motels & hotels. You choose to work where you work. No one forces you.

The main issue in this thread is that the protections enumerated in the 4th amendment only apply to searches conducted by the government, not private entities. So, if a private person conducts an illegal search and then hands over the fruits of that search to the government, that evidence is generally ADMISSABLE! The one exception is if a government agent (such as a law enforcement officer) requests that the private person conduct the illegal search. Then the private person essentially becomes an agent of the government, and must follow the same rules.

An employment test could potentially be challenged under collective bargaining agreements and other civil employment law, but definitely NOT under the 4th or 5th amendments, which limit the power of the government in criminal cases only.
