S2 You're right about the law. My lawyer assured me if I fought the charges and lost, the judge would sentance me to 18mos- do 9mos. Judge Howard Lytton,Dubois county has a set policy for all cases.

But, good news, since my first post things have changed. The prosecutor, knowing I was going to fight, and actually having a,as my lawyer says, 50-50 chance of winning has agreed to misdameanor possession charge-60 days house arrest,1-1/2 years probation. I get sentanced on the 31st of July.

I am the perfect little citizen. I work full-time, help support my girlfriends 3-yr old(her father won't pay support) and am an all around nice guy. I don't think smoking marijuana has anything to do with it. Or at least it shouldn't.

I'm pretty sure the probation depatment will be able to come in my house anytime, so I won't be growing. As a matter of fact I have already stopped smoking, and am not willing to even risk that while on probation. I am also high profile because I am area director of a reform organization. I don't know if LE would like to "get me", but i'm not taking any chances. It just isn't worth it to me.

My suggestion is to plead guilty to the joint and continue to claim ignorance of the grow site. If you are rational and polite about it the DA and Judge might work with you. If you can save their time by accepting a fine for the joint, they might be lenient...........

Angry Never ever plead a case.

Don't bargain with those bastards.(I direct that not at the person, but at the institution.) home monitoring, probation for 1 1/2 years. they will just make your life a living hell. better to just take the time. Make them pull a jury, exclude any one who you don't like, (in my state you can kick 3 prospective jurors for NO reason.) Plead not guilty and find 1 sympathetic person to hang the jury. If they retry, do it again, and again. until the prosecutor gets the picture. In places in cali. you cant get a prosecutor to bring a case. They know that if its jury trial they will lose. Play hard ball, you might just win. beheade

Its being done with out your consent already, 10,000 times a day. The point is to make that stand, that statement that you don't agree and aren't going to lay down and take it. Face the fact that many police agencies count on moneys made from persecution of non-violent drug users. When it begins to cost more to persecute these cases than they make off of the fines and fees, many prosecutors will be less inclined to continue. From my own personal experience if you contest the charges many times they drop rather than prosecute. (never had em drop a drug charge yet, unfortunately). Good luck what ever your decision.
