| If I'm going on a trip to Montreal (on plane of course cause i live in south america) and I have a new hammer bubbler inside my luggage and it get's X-rayed and I have to go open my bag and then they see it...is that like illegal..? Or are glass pipes, bubblers, allowed to travel on a plane...without the weed of course..? What can happen to me if I'm caught, etc....I'm not 18 years old either so...What do you think? |

| If it's never been used it's legal to have. But not if you're 18. |

| First off, if it hasn't been used don't even worry, although if they wanted they could probably try searching you after they found it, which you should keep in mind. If its used though, idk man. I think I've seen to much of that locked up abroad, I would never fly with anything on me. |

| I certainly wouldn't have it in my luggage while I have any weed on my person, in my carry-on, or in my luggage. X-Rays will find it and you will be carefully searched. I'm not familiar with the rules governing such things in Canada or your country of origin, but the presence of the piece would definitely make you a person of interest. |

| If it's completely CLEAN meaning never been used it's just a piece of glass and they can't confiscate it. You can say it's for tobacco. If you're expecting to smoke in Montreal and then bring it back, that won't happen. Buy some papers or something there. You'll find plenty of people tokin

In the United States (and Canada) bringing Drug Paraphernalia through Customs is not so simple as saying "it's for tobacco". *wink* *wink* - it is a crime. CFR Title 21, Chapter 13, Section 863(d), provides: The term ''drug paraphernalia'' means any equipment, product, or material of any kind which is primarily intended or designed for use in manufacturing, compounding, converting, concealing, producing, processing, preparing, injecting, ingesting, inhaling, or otherwise introducing into the human body a controlled substance, possession of which is unlawful under this subchapter. It includes items primarily intended or designed for use in ingesting, inhaling, or otherwise introducing marijuana into the human body. Items of a dual-use nature such as a cigarette rolling machine which could be used illegally can be subject to inspection. If such an item is found to have drug residue present, or if there are other indicators that it will be used with drugs, it will be seized. Water pipes, or bongs, are not a common method for smoking tobacco and not considered of a dual-use nature - and are specifically named as contraband in the cite. Items that do not have drug residue present or do not appear to have been used for illegal purpose may be allowed entry. It is up to the CBP officer to make the initial determination of primary intent or usage. If the item is detained, you will be offered the opportunity to either forfeit the goods or to have the case referred for prosecution by the U.S. Attorney, who will decide whether to prosecute the case or dismiss it. Meanwhile your entire family will be watching you debate this with the CBP officer, after experiencing their own luggage tossed in search of drugs.

This is a legal forum, answers should be based on legal facts and case law - not your opinion. The legality of a bong is very tricky and never "perfectly legal". | |
