Default Marijuana Technically Legal in Canada

According to the leader of the Marijuana Party of Canada, Marc Boris St-Maurice, Marijuana is technically legal in Canada. He says Marijuana is legal because the Ontario Court of Appeal struck down ban on possesion of Marijuana last year, and gave the Parliament one year to act. Since Parliament has not acted yet, all laws are invalid, meaning that any type of law related to Marijuana can not stick. Here is a link to the source of the Information.

The appeal court gave the federal government one year to amend the law, but Parliament has still not acted.

St-Maurice said this means the current law is unconstitutional and he wants to prove the law is unworkable. He added that any system that is unworkable is unacceptable because it is putting sick people at risk.
I don't know where you get that he said it is technically legal. He said it is unconstitutional and unworkable, that doesn't mean technically legal. I agree with his views, and I hope he wins his case. I'll be keeping an eye on the news for results from his trial that was supposed to be today.

I interpreted the technically legal part. I read an article last year about the judgement in this case. The article simply stated that if Parliament failed to act on this judgement in the one year given to them, then all laws against marijuana would become void. Since they are out of time, the laws have become void. I'm sure that won't stop the police though.
