| Hi all, I have just signed up to the board to ask users on this board whom can help advise me about a situation that happened to me a few days ago. I am 18 years old, never been arrested before, was in my friends car whom is 17 years old, went through the whole process of being searched etc.. The search was legal and what not, the question is what will happen in court. I know no one can say for sure but i was charged with possession of marijuana under 2.5 grams (smallest amount one can be charged with in illinois), however my friend was charged with 15 grams and a pipe. If i go in with a lawyer can anyone with similiar circumstances state what happened to them? Also, I am currently enrolled in an out of state college, if i get on probation i should still be able to attend correct? I am greatly convinced though that this will be the last time using marijuana as i have seen the consequences of what can happen and it's really not worth paying lawyer fees etc... Any help is greatly appreciated |

| You were charged with a Class C Misd. This is a very minor charge. It is up to you if you get a lawyer or not, you can have the BAR Attorney take your case. Let me know what County you got locked up in. I would say do your best to avoid having this on your record. You will probably get about a $100 fine, and attend "drug school", from their you should go on Supervision and as long as you follow it, it won't appear on your record. Yes, you can go to school out of state. So I am kind of jaded being a Cop locking up people for Felonies, and yes it is your life so it is scary right now, but this is really no biggie. Just do all the courts say. Your future jobs can depend on it, just don't count real hard on ever being a Cop or a Fireman. Now your friend will have a bigger headache.

| Thank you very much for your input, it is greatly appreciated coming from an LEO. Also, noticing your location I'm sure I was locked up in the same county you work that you are in, Cook. It happened in a northwest suburb of cook county. The thing that makes me really mad was that I got this charge without it ever being found on me. There was .3 of a gram found on "my side of the car" not even in a baggie, just basically a few flakes laying on the floor. The police officer explained it very well to me however, saying it was within my immeadiate "lunge area" so that it could have been mine. Oh well. I guess the Illinios criminal justice system has already had an affect on me, which is a good thing in a way. |

| Cook County, now you have even less to worry about...lol. Let me guess you are going to Rolling Ghettos, I mean Meadows Court House. I would ask for the Bar Att., no, this is not the Public Defender you get for free. The Bar Att. you usually will pay him what your bail was, so for you I'm guessing $75. Your first offense, say you learned your lesson, you want to lead a good life, you will do anything to have this off your record so you can lead a law abidding life, blah, blah and blah. $100 fine, attend "drug school" (basically a waste of time and tax payer money as to why drugs are bad and shouldn't do them, it was the Democrats idea OK), maybe do 1 or 2 days Comm Service, stay clean and no trouble for a year, poof, it's gone from your record. Keep me updated. |

| lol, you hit the nail right on the head, "rolling ghettos". I've been calling it rolling ghettos my whole life, cracks me up to hear you call it that. Thank you very much for your input, and yes I would do anything to have this off of my record because I am very confident that was my last time ever smoking, honestly. I just hope the judge believes me. Wow that's interesting to know the bar attn. will not cost that much, considering all the consultations I've had thus far are upwards of atleast $250. By the way, the whole time in custody basically the only things the police officers would ask me is to do a "buy" with them of what he said atleast 6 ounces from someone I knew (I never even met anyone with 1/2 that much) and i could get my charges lessened or dropped, is that normal procedure for cops to try to get small marijuana possessees like myself to do that? I told the officer that I think ratting people out for my own mistake is not right, and then said even if I wanted to I couldn't even lead you to someone with one ounce. Thanks for all your input. |

| This story sounds like most stories where someone young gets busted for possession. Heres a few simple things 18 to 20 something smokers should remember. 1) Avoid taking "bone rides" Yea I know most of us have done it, but yes its stupid and a good way to get busted for possession and DUI 2) Don't smoke or carry on public land (parks, beaches, forests) In my state the DEP has more power than the state police. They can search you without a warrant. 3) Don't dress or act like a punk, hippie/stoner. Those huge pants, nasty hair or grateful dead stickers all over your car say "PULL ME OVER I HAVE DRUGS!!!". Now im probably going to get a lot of flack for this, but its true. If it looks like a duck and quacks like a duck then its probably a duck. 4) If you ever get in the position where you have to deal with the police. Always be respectfully and assert your rights in a calm and polite manor. Yes, I know a lot of people don't like them, but they are necessary. So learn how to aviod them. |

| the police found an 8" pot plant on my porch. i am a homeowner and have no idea how it got there. no one was charged but we have to go to the detectives office. he said his boss told him someone was going to be charged with it. who? what are your thoughts about this kind of situation? |
