First of all, yes, I know I was very very stupid but it's too late now so I'd appreciate it if the comments be limited to advice and not name-calling.

Two years ago I was arrested for selling drugs. I had never been in trouble before; I was always a good kid and an honor student. I just had someone who was very close to me going through a serious medical condition and after spending over a year trying to raise money for her legitimately I got so desparate that I started selling ecstasy pills. I strictly sold them and until this day never consumed one myself.

After getting caught with 12 felony charges against me, I was cut a very favorable deal because the prosecutors sympathized with my situation. I was basically given five years of house arrest. After 9 months of being monitored, they moved me down to a probation level where I had the ankle bracelet removed but was still under strict rules and curfews. After three months of this, they moved me down to the lowest probation level -- no curfews, no restrictions, no drug tests, no reporting to a probation officer -- the only rule is simply "don't get arrested."

So after being under strict supervision for a year and now not being under any at all, my friends all want to bring me to Tijuana and then Las Vegas to celebrate. So for 6 months we plan this big week-long celebration and get together. I normally don't drink or do any drugs but I figure on this trip I'd go all out and just have fun.

I decide I want to smoke some weed while out there. It's something I don't normally do but figure two of the biggest reasons for the trip are girls and food and weed has been known to enhance both. Now my only question -- how do I get it from the East coast to the West coast? Having a felony on my record and technically still being on probation, I wanted nothing to do with attempting to bring it aboard the airplane. I had a buddy who lives in SoCal but he was going to be out of town that week. He couldn't think of a solution until the day before I was set to leave: He offered to let me use his Mail Boxes Etc. box. He told me he did this quite often: wrap the weed up twice, stuff it into a jar of peanut butter, and ship it FedEx. He said just to mail it to my name at his address and go pick it up.

So I do exactly that. I shipped less than a quarter ounce (five dime bags). I wrapped it in five ziplock bags meaning I couldn't even smell it holding it up to my nose let alone after shoving it into a 40 oz. bottle of peanut butter. I also figure (1) I need to use my real name to be able to pick it up, (2) they'll have cameras at FedEx and at the Mail Boxes Etc[MBE]. place and (3) my finger prints are on file. So if the box is opened I'm caught anyway so I put my real return address and my real cell phone number.

I stop at FedEx and ship the package overnight. I then get on the airplane and the next morning it's supposed to arrive at the MBE by 10:30 AM. I get there at 11:30 and they say the package has not arrived. I give the guy at the counter the tracking number and he says, "Well it shows it arrived here at 9:30 but we weren't even opened yet. They always just leave the packages here. We've NEVER had a package that didn't arrive on time via FedEx." I gave him my cell phone number and asked him to call me if it arrived. Then he says, "And I guess this means it was signed for by a delivery agent...I guess that's what DEA AGENT means."

I nearly had a heart attack. I got out of there quickly. When I got back to my hotel I went to fedex.com and typed in my tracking number and sure enough it said it was signed for by "DEA AGENT."

So now what? That was over a week ago and I've been nervous ever since. I'm back home in the East Coast and nothing has happened yet. What should I do? The following options have come to mind:

(1) Don't worry about it. It's like $30 worth of weed that they found in California and can trace back to the East Coast. Are they really going to follow up on such a minimal amount?

(2) Hire a lawyer. Get pre-emptive. With the leniency I received in my sentence, even a small slip-up like this will have me serving hard time unless I get a top notch lawyer.

(3) Confess. Again pre-emptive. Go to the police and take credit and tell them the truth and beg for leniency.

Any ideas?

Don't do anything until you know who, if anyone, the DEA is going after. It's possible that they won't come after you at all, as it isn't your box, but your friend will probably have a nice little talk with them. Get your stories straight, and get a lawyer if your friend mentions your name. Right now, for all you know, the DEA might think your name was a randomly chosen alias.

well my best advice is to not do ne thing.california has thousands of pounds of pot floating around.its not like they r gonna chase after some person for a couple grams

I would definitely be worried if I were you in this situation. You said not to complain or criticise so I wont. Listen, you very well could be under surveillence. The DEA and FBI like to watch and wait before they make a sting.

You were originally arrested for dealing, right? And now you send a package with grass across the country and it was seized by a DEA agent?

You are most likely being investigated for narcotics trafficking.

While the amount you sent by package was not much, your history of excstacy dealing will put you under close scrutiny.

I reccomend that you contact a GOOD lawyer who is experienced in these matters immediately and get any and all legal advice.

Be careful about the lawyer you hire too. Some are willing to take cases they may not have much experience in just to make a profit. Make sure he is well qualified to handle the case.

Also I would recommend you talk to your freind who has the mailbox. Make sure to let him know what is going on. It would be best to contact him via payphone by using a calling card. No email. You could try to use AIM via public computer terminals as such in libraries.

If you and your friend have access high speed internet and a mike, you can even attempt communication by using such "voice communication" programs such as Roger Wilco or something like that which allows users to communicate by voice over the internet. I don't know if that could be monitored by investigators though. You could use them from friends houses.

Talk to your friends about this in person and get their advise too.

But definitely talk to a lawyer.

Just don't take ANY chances with anything.

If you or your friend have possession of ANY illegal items or drugs, I would recomend that you dispose of them immediately.

I would hire a lawyer, partlly because in your situation, I would be extremelly paranoid... maybe your not like that though. But I would think it might be a good idea to have a lawyer around, even if they don't persue it. And hey, if you don't have the cash for the lawyer, you can always sell drugs!

I would definately worry about it, get your story straight with the friend and seek legal advice. Just because it has been a week does not mean it has gone away. A friend just got into something similar and it was several weeks before he got the dreaded phone call.

Another thing.

Even if you take all necessary precautions and even hire a damn good lawyer there is still a very good chance that you will be facing some hard time unless they give you some deal.

You might want to prepare yourself for that fact. Maybe try picking up a copy of "Idiots guide to surviving prison". I'm sure there's probably a book like that out there.

I totally sympathize with your situation, being that I have both been on house arrest and probation for 4 years. You would think that they would have better things to do than to bust a probationer, but it's not about that. It's not even about the quantity. It's about that infamous revolving door of probation/parole violators that keep our legal system fat and happy. My guess is that this is not going away. That they will violate your probation and reinstate the original sentence for which you were given leniency. GET A LAWYER... Or leave the country!!!

Yes, I was actually going to suggest that in my original post but didn't, but you really might want to consider getting out of the country.

Be careful. Have you got any skills? If you are physically fit you can always survive on physical labor work overseas.

While I am against the idea of what we are suggesting, in your case you may not have much choice. Seeing as how they have not yet informed you or put a warrant out on you, you can always claim you were going on vacation for some time if it ever comes down to that.

Like I said, if you do stay, you are facing some hard time behind bars.
