Earlier today, I went out with a few of my friends to go to the local In N Out burger and just hang out. My two friends, however, decided it would be fun to mess with some lady and piss her off. They proceed to give her the finger and yell as we speed out of the In N Out burger. Early tonight, after everyone had gone back home, I get a knock on my door. It's the woman and her husband.

She asks me if I was in the same car that my friend drove that day, and I thought about lying to her but decided to tell the truth and I answered yes. She asked who my two friends were, and I wouldn't tell her name. She then threatened to get the authorities involved if I didn't tell her, but if I did give names, then she only wanted to talk to the parents of my friends and get everything straightened out. I told her my two friends names, and asked her if she could give me some time to talk to them tomorrow at school and have them tell their parents. She was very kind and said she would, which I was thankful for.

My problem is, my two friends saw me smoke weed and they knew that I had a sack on me. If they decide to not tell their parents and get this all straightened out, she WILL get the authorities involved. I'm afraid that if I my friends get in trouble, they will tell the police that I have some bud and that they saw me smoke it. I dot not care if my parents find out that I smoke, but I do care if the authorities get involved. Here are my concerns/questions:

1. Would the police be able to do anything about this?

2. What rights do I have in this situation?

3. If this does happen, should I just deny everything or tell the truth to the authorities?

Thanks, I know this is a long thread, but I wanted to you guys to know everything that happened.

i wouldnt worry all to much about this problem, firstly if your friends would actually rat you out like that they arent good friends, and secondly if you havent got any bud left or if youve hidden what u have left carefully. If the cops do actually get involved you can lie your a$$ off or tell the truth cause having smoked weed in the past isnt illegal

Just so you know for the future, while your friends were pricks, there is nothing that she could take to the cops that could get you in any trouble. Any report she attempted to file would be worthless.

Yep, she's just angry at what happened and is wanting to get even by making you and/or your friends feel bad and be scared of getting into trouble.

If she actually went to the police and told them she wanted them to do something about some kids giving her the finger, they'd laugh at her.

Not on the basis of your "friends" statement alone. There is a possibility that a warrant could be issued based on such a statement. Until the situation clears up I'd keep my stash somewhere other than my house.


I don't understand the question. You have the same rights as anyone else. You don't have to testify against yourself, they can't search your house or car without a warrant, you can demand a trial by your peers, you can't be subjected to cruel or unusual punishment, and you have a right to confront your accusers. Could you be more specific about what you want to know?


Say nothing! Tell the cops you don't accede to being questioned without your lawyer being present, then shut up. Cops are trained to pick apart your lies and telling the truth might reveal things you don't want them to know. Under the Fifth Amendment you can't be required to say anything detrimental to yourself. Your lawyer will tell you not to say anything and you will respond to their questions through your lawyer.


I'm not sure that your friends did anything illegal. There may be some old law on the books about "obscene gestures" but mostly such things are protected by the free speech rights of the First Amendment.

Thank you guys very much for all of your help. I just got back from school a little bit ago, and the whole day was spent talking with my friends about this. One of them called the woman who this happened to, and apologized. The other, who actually gave her the finger, talked to her after school and it's all fine now. Thanks for all of your help!
