| I was recently arrested and given a citation for a drug abuse charge(possession) and a paraphenalia charge in Ohio. I had an underage drinking charge dropped a while back but I don't think that would be traceable. Basically I have no prior record and was curious what I should expect as a punishment and if more than a court appointed attorney would be necessary. I am pretty paranoid about this because I am a poor student. I would greatly appreciate any advice anyone could give me. |

| If you can afford I would always get my own lawyer over a court appointed lawyer. The court appointed won't spend as much time on your case as your own lawye would. It's just a matter of cost. ![]()

| A lawyer probably isn't worthwhile, unless you think the search was bad and you want to try to get the evidence supressed. In Ohio, marijuana is decriminalized, meaning it's only a civil citation. However, the paraphernalia charge is a misdemeanor with a 30 day jail sentence. What will probably happen is they will offer to drop the possession charge in exchange for a guilty plea on the paraphernalia charge. Than they'll offer you a choice between some type of pretrial diversion, meaning probation, fines and community service, or fines and possibly a few days in jail. If you take the pretrial diversion, the misdemeanor won't go on your record. Hope that helps.

| If you are a college student or p[lan to be one, or intend on any career that might require a background check, I would strongly urge you to consult with legal counsel.
