| It depends on what state you live in and what caused the cops to raid the house. Other questions I'd need an answer to are; Were children around? Did your buddy deal? What is his record like? Is he on probation/parole? Once you've answered those it will be alot more likely that someone here can give you a real answer. Ordinarly, in most states, a pound is enough to qualify as possession with intent, which is a felony.

http://www.norml.org/index.cfm?wtm_view=&Group_ID=4544 There's a link to Michigan's marijuana laws. He could be charged for possession, distribution without renumeration, or possession with intent to sell less than 5 kg. If his record is clean, he can probably get a conditional discharge with any of them if he gets a lawyer. The fact that the warrent was for coke does not matter, as long as the warrent itself is valid. Most warrents also allow police to sieze anything illegal found within the scope of the warrent. If the warrent was for a fugative and they found the weed in a shoebox, there might be a defense, but not in this case. | |

| May I suggest that the key point to WNB's post was to get a lawyer. A public defender will not help much here and your friend needs a real bulldog lawyer that would sell his/her mother to get a client off. For that quantity, your friend rides on the border of numerous charges and as such could really be negotiated to a suitable circumstance with the District Attorney. |

| One more thing. Every person that gets arrested has a right to know what they will be charged with. Since this seems to have slipped your friends mind, he might try asking what he is being charged with. Of course, then get a lawyer. |
