| A few weeks ago on Saturday, I called my friend up to pick up a bag. I told him I would meet him in the parking lot of a company close to town. I knew that this company was closed on the weekends, so there wouldn't be cars/people in the parking lot. When I walked up, he was already there waiting. I looked around, ofcourse, and spotted a single camera in the front of building about 50 feet away. I shrugged it off, not thinking much of it, got the bag and left. Nothing happened to me, but I'm a little curious about this subject. Would the police be able to do anything in this situation? Could they view the camera and use that as evidence to prosecute me? Would they even take the time to do something like this? What are all of the legalities? Thanks. |

| The police would never see the tape unless the company called it to their attention. If the police had reason to suspect that a crime had been committed there the tape could be subpoenaed as evidence. If the property was posted "No Trespassing" the tape would be evidence of that crime. Unless the camera included some kind of sci-fi spectrometer there is no way to know what was in the bag so it wouldn't be evidence of any drug crime by itself. All it says is that you and your friend were in that parking lot at a certain time.

| cameras in public areas, id be concerned. cameras on public property, i dont really care so long as theres not a serious crime going down in the same area at the same time.

| Maybe..........but normally, when it was turned over, it would be taken on a property reciept that the providing party would sign, providing evidence that the tape was turned over voluntarily. Not a bad practice, but not needed or always done. |

| Of course a store's security video of the parking lot would almost never be looked at unless there was some reason for suspicion; a break-in or something like that, or someone reporting a couple people meeting in the parking lot for what looked like a drug deal . . . |

| I have a Love/Hate relationship with surveillance cameras. I remember at a campaign stop in Boca, the candidate I worked for had been the deciding member on the Senate Commission who vetoed "cameras At Intersections" -- a popular idea in that community to spot red-light runners. His statement was that he did not like the idea that the cameras could be repositioned to look at the buildings, sidewalks, etc. and held his veto for cameras that would stay focussed on the cars ... He expanded that he didn't want his State becoming a scene from a Sylvester Stallone Movie. One of the few things Me and the good Senator from Dade & Monroe agreed about ... Stilted by "term limits" (what a ridiculous concept -- you limit terms by VOTING) the Senator has since moved on to the private sector... And Boca and most of South Florida got their Red Light Cameras... and yes, they do move... Now I live in South Florida ...where Big Brother is Watching You ... but I figure there is so much to watch that I'm still pretty secure, my privacy is safe by merely being in plain sight. | |
