will getting caught with lets say an 8th of marijuana go on your record? If it does go on your record will that have a real negative effect? I know it depends on what state you live but i was wondering if someone can give me some general information. I tried searching for this but could not find anything.

To find out the laws in your state, go to the NORML US Map and click on your state.

Having a drug conviction on your record can have a negative impact on getting a job, getting into a college, and getting credit. In some states you can't get a concealed carry license. If the conviction was a felony it gets even worse.

If you stay out of trouble, sometimes you can get a misdemeanor conviction expunged. That seals the record so it's as if it never happened. Or so they say. I recently discovered otherwise.

Read your state laws and find out what you're letting yourself in for.

if its your first offense, most likely with a good lawyer you can get it off your record...

no necessarily....I was arrested with under a gram of marijuana, and am still looking at getting it removed after 3 years, during which I haven't been in trouble once. Due to my situation (I have a degree in crim justice) I originally attempted to get a suspended imposition to keep it off my record, but the judge refused, citing that he only does suspended impositions on felony cases. Of course....later, during the same court session, he handed out a suspended imposition for a DUI case (first offense-misd.). Of course, judges don't have to be fair, I guess.....although it sucks getting lied to by the man holding your fate.

has having that on your record made your life more dificult? Like getting a job or something?

Well, considering the fact my degree is in criminal justice, yes, it has made things a little difficult. To further complicate matters, I was working for the state as a correctional officer when I was arrested, so essentially, I was busted AND fired on the same day. A record brands you as a criminal in the eyes of many people, and having ANY kind of drug offense on your record hurts when it comes time for employment. After all, if two people were completely equal, aside from the fact one had a drug convition, who would get hired? Its amazing....basically a drug conviction (at least in the eyes of employers in this area) basically nullifies a college degree. It really hurts to see some kid fresh out of high school get a job I was deemed unfit for simply because of a conviction. The hyprocrisy that irritates me the most is the nonchalance convictions for drunk driving are treated when compared to a cannabis conviction. I was hired by 2 state agencies while having a DUI on my record, and it wasn't even questioned. I was hired and everything no problem. LOL....the State won't even give me the curtosey of a callback with a marijuana possession charge as well. I find that sickenly funny....while I was drinking, I was on the road putting lives, both my own and others,at risk. This behavior is deemed somewhat ok, I guess, as no one ever questioned it even when I openly admitted it on my job apps. However, smoking a joint in the privacy of my own home was enough to not only convict me and take my job, but also create a significant difficulty in gaining any other employment, other the menial jobs. I'm happy to say i am employed and have been aside for a couple of months after losing my job. However, it sickens me to think about how much money I'd be making at my old job if none of this had ever happened. I'd be making roughly double what I do now........

When I got busted a few years back I got a lecture from the judge about how drug use hurts children and causes drug gang related murders, and is therefor not a victimless crime. It took all my willpower not to tell the ****er that those are the fault of prohibition, not pot itself.

Anyway, as far as the thread goes, a record can and cannot cause problems. Most employers will not conduct a background check, and if they do it will only be searching for felonies (although this varies from state to state). As unethical as it is, I'd suggest lying on your job applications unless the company you are applying to is known for conducting background checks.

I'm not sure what industry you work in but, almost every company I have worked for or applied to work for, has conducted criminal background checks. In the state I live in all crimes show, felonies and misdemeanors, including traffic citations. Lying on the application will result in immediate exclusion as a potential employee or if they discover it after you're hired, will result in termination. I did notice at the very large company I will hopefully be starting at soon (hint it is an international hotel chain with a very well recognized name and classy reputation), they ask you to list everything except traffic and MJ charges that are over 2 years old. That was the first time I have seen that on an application.

Usually having only 8 grams(1/4 oz.) will not get you anything other than a misdemenor on your first time. Misdemenors are rarely required on applications and normally do not appear on most background checks. Secondly, having a case sealed does not mean that they cannot re-open the case if a second case is being disputed.
