I was wondering, what would give the police probable cause to search you? Could they randomly pat someone down, or could they take a random tip and search you? Also, if police drug tested you, and you failed, but you werent caught with paraphanalia or drugs, could u be charged with anything? If someone has a link to a website with a nice outline of search and seizure laws, that would be great. thanks!

A search of this site would provide you with a great many threads dealing with this issue, but I'll do my best to answer some basic questions. An officer can do a quick patdown under almost any circumstances, but it has to be a basic patdown, looking for weapons only. Random tips are not probable cause for a search under most circumstances. A urine sample, in MY home state, if positive, can actually get you arrested for possession of whatever drug you were "hot" for. However, most states are not like this. IF YOU ARE DRIVING- a positive urine test can get you arrested for DUI or DWI, though. A search on google or this site can provide more accurate, detailed information though, as these are just very basic answers, and many are dependant on details. Every situation is different, meaning that the most basic of answers certainly don't apply to each and every case.

this is kind of a question to go with bhamlaxy's...

Can they search you if your just walking/standing around at like the movies or the mall or something? Like just come up to you and search you? I used to get paranoid about bringing pot out because of that.

Also, if they come up to you and pat you down for weopans for no reason whatsoever, would they also "secretly" do it for pot too?
