Heres my story...at my high school students arent allowed to leave the building without permission. So, sometimes if i were to forget my lunch money or need to put a book into my car i would simply ask the front office and get permission to go out to my car. Well, on this day i hadnt asked. I just went to my car and got my lunch money and walked right back in. After entering the office and procedding to the lunch room i met up with an administrator saying that i have been suspected of just leaving the building to smoke in my car. Teachers up and down the hallway could see me leave and sit in my car and smoke. So the administrator asked me to empty my pockets in search of a tabbaco product. So i emptyed them and i had a baggy with half the size of a dime (Coin not a dime bag) which was just shake. He then suspected it to be marijuana and called an officer down. He confirmed it was marijuana. They then proceeded to check my car and found a homemade bong out of a water bottle. Last night i went to a board meeting for my school and was found expelled for 180 days as well as my license revoked for 180 days. Last night the police officer also told me that they had dropped the charge of possession of marijuana because it was under a gram. Now I still need to go to court for possession of paraphelia. Does anyone know the consequences for this. Probation? level 3? community service? Would it even help to get a lawyer?

I don't know what to really say beside the fact that i can't believe they pulled your license for 180 days. You might have smoked in your car but you weren't driving it at the time. Then again pots illegal so i guess it's an automatic suspention for just having it in the car.

As for the teachers seein you smoke, for all they know you were smoking tobacco which is probably why they wanted to check just to make sure it was that and not pot. This administration member isn't a cop, how this works is even if let's say they searched you, it wouldn't be considered an illegal search when a civilian does this, theres been cases where even a bus driver found a backpack a student forgot, opened it, found 3 pounds of pot in there, then called the cops, it didn't go down as an illegal search.

It definatly sucks, but as far as searching goes, the administrater didn't empty your pockets for you, he asked you to do it and you did, you pulled out the bag, he observed it, then called the cops who then had seen the bag themself which was now in plain view. It might not even make a difference but as for the paraphernalia being in your car, it was in your car but you were on school property/private property.

I'm not a lawyer or anything but you might be able to argue that when it comes to losing your license. I'm not saying i'm right about this though, there was illegal things in your car no doubt about that, but when it comes to the whole license situation this happend on private property.

Again i'm just saying my opinion about this and it's probably not even a right answer, but before you spend money on a lawyer you can atleast just call one and tell him/her what happend and ask questions about the whole incident and find out if theres a possible technicality in the incident.

Another thing that's a joke is you had under a gram of pot so they drop that charge, but get you for paraphernalia. Maybe they did that because either way one charge or the other would probably get thrown out in court, they usually drop one or the other. Also could be that maybe the bong itself was what got you your suspended license and not just having less than a gram. That would make sense anyway cause the pot wasn't in your car when you took it out of your pocket but your bong was. As for the private property matter, not sure if that will work because i just remembered, not sure about your state, but in my state, they consider more than 10 spaces in a parking lot public property and not private. I know someone who tried to get a reckless driving charge thrown out for doing donuts in his car one year, tried to use that in court but they just said if it had more than 10 spaces it's public.

Unless I missed something, I fail to see where you were busted for the wrong reason. Bringing MJ into a high school - "drug-free zones" that they are - is not worth the risk. My friend Troublemaker frequently questions why so many young folks are inclined to carry their weed around all the time, and in this case I join him in sincerely asking that question of you. A little dime-bag of weed got you a whole lot of embarassment and grief - why would you take it to school?

The plethora of busted stories on this forum always seem to contain a common theme. The subject was doing something they ought not have been doing, bringing about suspicion, and then the authority finds the weed. The secondary factor seems to be vehicles - having MJ in the car unsecured, smoking MJ in the car and MJ paraphanalia in the car. By now one would think that the lesson is clear - a teenager's car is not a safe place to keep weed, smoke weed or protect your constitutional rights.

I think the legal ramifications are outweighted by the social stigma of being identified as a stoner by the school - but I would always suggest retaining a competent lawyer for preserving and protecting your future in the face of these accusations. A lawyer should have been included in your appearance before the School Board and subsequent suspension. Time to start studying for that GED.

And I assume you lost you license because you are a minor.

When you signed up at Marijuana.com did you notice that you were asked how old you were, and that it said you had to be 18 to join this board. We do not cater to minors, but you are more than welcome to come back in a year (or whenver you turn 18). With that, thread closed.
