Hello my name is David and I live in Fresno, Ca. I got the nickname edgewater when one night in Pismo my friend got super high and asked why everyone called me edgewater, when prior to that moment no one had ever said the word edgewater. I listen to a lot of modest mouse, at the drive in, mars volta, muse, thursday, and a lot of other ****. Aug 1 I am planning to move to Santa Barbara and go to school there.

Last night I got caught smoking marijuana with three other friends by a couple of rangers. Me and my friends wanted to go away from the city where there weren't any city sounds and where we could see the stars. We accomplished that. We went up this road called sky harbor, got to our destination, smoked one bowl, the second bowl was packed and about ready to hit rotation when we see headlights coming down the side of the hill. They aren't cop headlights, some SUV, so we are calm, and my friend puts the weed and pipe under the passenger seat, lights up a cig... rangers come... ask us what we were doing... we are like just chilling, this and that... ranger walks around my car maybe like 20ft and tells us he smells marijuana smoke. One thing leads to an other, one of my friends is coming off a DUI so he is pretty nervous, eventually they get the weed and pipe, search us, search the car, find nothing else, give me a misdemeanor and tell us to call some friends to pick us up and drive my car home, because I was 'under the influence' and couldn't drive.

I recieve Veteran's Benefits from the government because my deceased father was injured in the Vietnam war passed a certain percent to where I get the Governers Board Fee Waiver and a check each month when I am in school and only if I am a fulltime student.

With this misdemeanor will I still get veteran's benefits or will they stop now? If they stop, I pretty much can't move to santa barbara, will be stuck in this city, with a disapointed mom, and a whole bunch of regret.

I have my court date, should I just wait til then? Should I contact Veteran's and ask them, or what? Also, will this be stuck on my record forever?

I can't sleep, so I've been reading other people's stories on this forum and going through various websites looking to find some answers and hope.

The only financial aid you'll lose is stuff you had to fill out a FAFSA for. I got busted a few years back in colllege and got to keep all of my scholarships, and have gotten two more since then -- I never filled out a FAFSA for any of them.

It sounds like you'll be fine, don't worry about it.

that's good to know. think i'll get charged more for the pipe that they found with the bud though? even if it's really not mine?

Where do you live? In CA, weed is only a fine and won't show up on your record. Unless you really piss off the judge.

That is incorrect, in California it will show up on your record as a misdemeanor unless you do some sort of pre-trial diversion.

Dunno about you, but in the Bay Area, if you get a ticket, its 64 dollars and won't show up on your record.

Not to harp on your bad legal advice, r2x, but the fine is established by state law and has been $100 for many years, with an additional $210 Court Administration Fee because the cost of processing the ticket is greater than the recovery of the fine. Bay Area or not, $64 is simply not true. /just saying.

Isn't it possible that there is a local ordinance in the Bay area concerning marijuana possession? Many localities have such ordinances, and many possession cases are charged under the local ordinances rather than by the state law. I believe this is the case in ann Arbor Michagin, among other places
