Is there anyone here who has been busted for paraphanalia/possession (first offense, clean record) and can tell me what happened?

Doesnt matter what state, Id just like to get an idea of what I may be in for .

Sure, the forum is for discussing legal issues, and there is no "harm" in discussing it. The poster is seeking specific advice while the arm-chair lawyers are bandying about opinions and speculation about who is the oldest member here. As informed as our members may be, TimmyP is still not going to know anything for certain until he decides to talk to a lawyer and detail the specifics of the incident. "Seek the advice of an attorney" IS the best answer to most any question here.

I'll tell you what I usually recommend for sentence when someone pleads guilty to a first offense, minor amount of marijuana with a clean record:

$250.00 fine + penalty assessment = $300.00 total
30 days county jail suspended for two years contingent on good behavior
if the driver of a motor vehicle, 60 day license suspension

So, you would have to pay the fine. If you did not get arrested for two years, you would not have to go to jail. And since you were the passenger, the license suspension would not apply. But, that is just me and the courts I usually make arrests in. Other cities, counties, states, and jurisdictions will do things differently.

Id take that with some relief, but I still have to pay the 750.00+ for paraphanalia.

Another question, Is there a way I can get an earlier court date? I plan on pleading guilty and really wish I didnt have to wait another month and a half to go to court.

Not really. You can get a continuance to delay a court appearance if you show good cause, but I have never heard of someone getting a court day moved up. Also, not wanting to wait doesn't count as good cause. You're just going to have to suck it up and wait.

If you guys were smoking in the car, it smelled like pot. That's the short answer.

Unfortunately, you guys have chosen something that has a unique odor that is VERY noticeable to someone who doesn't smoke it. You won't notice the smell, but everyone else will.

If the odor of mj was present, that is probable cause and every inch of the car can be searched.
