What's up (I'm a new user)- OK, so I know this is aleady very dumb of me, but I was caught w/ possession of marijuana the other day (traffic stop). The fact is that the officer should have never of found it cuz he claimed I was intoxicated (I was not at the time), and put me under arrest claiming that "you're eyes never lie". Then proceeded to search my car and you know what he found. I have a very good lawyer who happens to know the judges and everything. What I was wondering, was that if it is safe to still continue smoking herb? I have already went to the preliminary hearing (pleaded not guilty) and have to go back June 20th. My lawyer said he can possibly get the whole thrown out or just get a slap on the wrist. BUT- can the judge ask me to submit a urine test to see if I have been clean since? My lawyer said this could happen and I don't really wanna quit for a month or 2. Now I dunno if my lawyer is just telling me this (he really doesn't like cannabis) to keep me off it or if it really can happen.. Can someone give me any insight? Keep in mind that this is my first offense and it was the first time I have ever been pulled over. THANKS a ton

| Your lawyer is being straight with you. The court can require a drug test and use the results of a drug test to determine what kind of sentence you get. If the test shows that you have no respect for the law - because you smoked after getting busted - they would be less inclined to give you a break. If your lawyer can get the case thrown out on a technicality it wouldn't make any difference, but I wouldn't count on it and, apparently, neither would your lawyer. The drug test could mean the difference between getting a slap on the wrist and getting the maximum penalty prescribed by law.

I undertsand. I go back June 20th, and was busted on May 28th but last time I smoked was June 3rd. They won't ask me to do a test right when I go back, will they? It hasn't even been a month or so to get out of my system, and I'm not even gonna try that cover-up ****..

June 20'th is not too far away and considering the consequences, such as probation and a nice fine, I would stay clean and do everything I could to clean my system out.

What I'm saying is that it wouldn't be fair to urine test me the 20th because there hasn't been enough time for it to naturally get out of my system. And plus if they do put me on probation (doubt they will, I have a wicked lawyer)- I'd have to submit a test every month and it'll still suck. I'd think they'd take my license away before putting me on probation because I also was arrested for "driving under the influence (of marijuana)", which is all bull.

If you were to test positive on the 20th it would tell the court that you are a chronic user, as an occasional user would have been clean in three weeks. That would be a consideration in how to dispose of your case. I don't see any reason why you'd test positive if you use dilution & aspirin. Dilution and aspirin-- the technique DILUTION: tips, tricks and guidelines from N2 You're right, they probably will take your license away. In many states you lose your license for a possession bust even if you were nowhere near a car. In many places a probation officer can call you in for a UA at any time. It's too easy to beat a monthly test. My best advice is to quit smoking until you're off probation.

I also don't know if you guys remembered me saying that I could get the entire case thrown out (due to how the cop handled the situation) or a slap on the wrist. Being put on probation sounds like a lot more than a slap on the wrist. Keep in mind this lawyer has gotten my uncle off his 3rd DUI charge and he blew WAY over the legal limit. I still do feel pretty good about this whole thing, it's just the matter of if or when the judge will ask me for another urine test.. PLUS, that's a LOT of aspirin to be taking for that dilution method. We'll have to see.

Probabtion is a slap on the wrist. As for hoping that you can get the case thrown out that's fine... but I'll say this nice. You can hope in one hand and sh*t in the other, see which one fills up faster. Just be a man and avoid the bud until after your court date, its that simple.

Don't get cocky.....expect probation at a minimum if the case doesn't get thrown out.....
