I was in a gigantic bush at a public park sitting with a group in a clearing. In the group was a small black kid, 15, an 8th grader, an 18 year old with a bottle of wine and a cannabis card with a strain called grandaddy, a kid smaller than me but my age, and 3-4 older bums that had been drinking.

the cops rolled in on a cause of which i read from the lcd in the cop car, ongoing problem of adults drinking.

they came in and accused us of smoking marijauna with no evidence, questioned of illegal things, 18 year old says he has a bottle and they search his backpack and find the LEGAL grandaddy.

i did not have ID so I gave him the details and he accuses me of smoking. he says "your gonna tell me that with those eyes you have not been smoking" i said theres nothing wrong with my eyes. he says "would you like to take tests to prove that you have not been smoking" and i said "i wouldnt like to because tests cant prove i have been". somewhere in there he says i was being a dick because i told him i did not want to hear his accusations and id rather remain silent. he picks me up, cuffs me, takes me to his car, says im being arrested for under the influence (which came from red eyes, and a supposed GREEN stain of the inner mouth by my throat that my father couldnt see). there was no specific articulating evidence, just suspicion. upon arrest and search, they find visine (for my red eyes), a legal pocket knife, brass knuckles (which ive been told can be classed as a collectible paperweight), and $10.

my argument would be i was arrested on suspicion, red eyes from games/computer/tv, visine to fix it that i had not used, maybe id have to go down for the knucks (paperweight?). i was singled out, called a dick, and detained for no reason. I got up to leave and was commanded to sit back down when i said I have to go. my pee tests will come up clean.

much too young to be hanging out with bums I'm sure... if youre gonna smoke weed do it somewhere safe AND NOT ON PUBLIC PROPERTY!!! Discretion is the key.

If you're smoking in public with drunk bums, pretty much anything the cops would do is legal. Try keeping it in private and being a little more discriminating in your smoking partners.

He never said that.....the actual FACT of weather or not he was actually high never got mentioned. Of course, and maybe I'm just a pessimist here, but the arrest wouldn't seem nearly as "wrong" if he was indeed high. Maybe the actual FACTS of the case were conviently left out on purpose.....and dude, good luck arguing that the brass knuckles you were carrying on you getting classified as a paperweight. Maybe if it were on the desk of your office or in a display case, you could argue that, but when its found to be in your posession in a public park, no one's going to buy that you needed it to hold down some papers. It ceases to be a collectable when its found in such a manner that it clearly wasn't being used as one. How many people haul "collectables" (especially those that are/resemble weapons) a public park. No court is going to see them as "collectables"...just as brass knuckles, which is exactly what they are.

he says that it was legal for an 18 year old to have alcohol, was he in Canada? If so the laws may be different.

Actually, i reread the original post, and no where does it say that the alcohol was LEGALLY in the 18 yr old's possession, just that he claimed ownership of it. Since he was searched shortly after claiming ownership of the bottle, its likely that the search was done incident to his arrest (the unnamed 18yr olds). Just because someone claims owership of something is no reason to assume that whatever was claimed is actually legal for that person to possess. People admit owership of illegal contraband every day. The only thing he said was legally in the unnamed 18 yr old's possession was medical cannabis. No mention of the wine being legit for an 18 year old to possess was made.

Edit-actually, the 18 yr claimed ownership of a BOTTLE....no distinction was made as to whether this was the wine in question, or the cannabis in a pill bottle or something similiar.

Cop: Hey, do you own that shirt?
Me: Yea.
Cop: I'm pretty sure it's stolen, and therefor contraband.
Me: No, I swear it isn't officer.
Cop: Haha, right, you're under arrest! I got you good you ****er!



I suspect the drinking in public and being with a bunch of bums is what gave the cops cause to search.
