I'm heather and i'm 19. unfortunately I'm stupid as well

Somewhere's around may of 2004 I got busted with my friend. we were driving in my car, tokin like usual. we were SO cocky... a cop pulled me over for my headlight being out. I didnt even know it was out til he told me, it wasnt even totatally dark! well we got busted and had about a half oz. on us. and 2 metal bowls. I was 18 and my friend was 16, so she went to juvinile court, where she promptly told them it was all mine! she told the cops that also. and that I had bought it at the Detroit techno music festival that day.. which wasnt true. In reality we stole it from her dad's freezer bag full of pot. I was smoking it, but it wasnt mine. she was my bestfriend and that was the BIGGEST ever stab in the back. well we werent friends any longer.. so I told the cops in court where it came from and that it wasnt mine.. they believed me.. so I thought. I was under probation or advisment under the 7411 thing...... under that I wouldnt have a record..I was at the time of my first arrest going to school to become and EMT. now I'm going to school to be a nurse.(btw I have the grades, EVEN THOUGH I smoke/smoked) so the no record thing was marvelous..... it gets horrible after this.

My court date to LET ME OFF was the 8th of august. wouldnt you know in july I get busted AGAIN. I didnt smoke for a long time... but I had begun to daily for about 3 months prior. I mean I smoked 5 times a day.. very heavy smoker... this time I had maybe a dime most likely less.. it was in a match box that was in my car in the center counsole. My friend and I stopped at mcdonalds, I hit the bowl once in the parking lot, stupid I know. I was ducking down and I had this thing over my windshield to "keep out the sun". anyways we decided we'd go to my house to smoke.. after getting some micky d's. We come out and i notice a police car hiding behind mcdonalds... I thought it was wierd but I got in my car. I had a funny feeling. I was like ****.. I hope he doesnt come after us.. well he did. in the parking lot on my way out he pulled me over. before he came after us, while I was backing up, I searched my hiding spot in my car and found a baggie with about an 8th in it.. that went down my pants in a jiffy! but not very well.. it was hanging out halfway. His lights came on and I parked. I rolled down my window.. he asked for my license and all that... then he said "do you have anything in the vehicle?" before I could speak he opened the door and said to step out.

I got out of the car, and he frisked me. I'm a gal, btw. he put his hands in my back pockets and took out a pen. I was thinking... wtf he's touching my ass. He put me in the police car. and then got my friend, put her in the car. and searched my car. He didnt ask to, but I dont think that counts. Not only did he find my matchbox, but he found some seeds in a crumpled baggy and a glass bowl in my backseat. that stuff wasnt mine. I drive alot of people around, and he showed me it. I thought he was bsing me. But there was another cop that said it was there.. so I didnt want to claim those.. he threatened to take me straight to jail if I didnt say they were mine.. I tapped on the window and asked to have my parents get my car.. towing is expensive. so my dad came and got it.. whew. He opened the door, put the cuffs on and got in. he asked me where I got it. who sold it to me.. why I smoked. and other things that I cant really remember. and he farted horribly. sick. I also asked to let my friend go, cuz it wasnt hers. he did that also. they drove her home. He never read me any rights.. is that unlawful? They never found the weed down my pants either. thank God! Apparently someone called in an annoymous tip that said we were smoking in the parking lot.

And, when, not if I'm convicted. cuz police are ALWAYS right, does anyone have any idea what kind of punishment I'm up for? This is macomb county mi and I cant find anything on it on the net! I have a lawyer also. thanks for anyone who read this and happy toking cuz I've stopped for now.

Let's review the math:

Not sure I can be much help after you say

But you can convince me that you have a poor choice in friends.

Not what you want to hear but the truth be told you were real sloppy. And I am not sure that makes for a good EMT or Nurse; and note that habitual "drug use" prevents you from working as either. You now have a record of two arrests for MJ - your real worry should be your future and how these minor incidents will effect your ability to get employment and pursue your career. Follow your lawyer's advice exactly.

I already know that using pot wont get me or keep me a job... I work wiht mentally challenged folks now,a nd thankfully, my company doesnt drug test. But I did quit for many months, but over the summer I've been smoking as school hasnt started yet, except for my summer pathophysiology class, which i'm getting an A in. Pot does not effect how you do in life! its these laws..............

I also already know about the criminal record... and I've talked to alot of people at the school... and everyone says that it shouldnt be a huge problem, as it is the grades that matter and the knowledge of the profession.. I have that no prob. Also I graduate in 2008.. a few years away. and they were misdemeanors. usually cerfication is denied with crimes such as abuse, neglect, and that sort.. none of which i have.

and I can assure you the things werent mine, as I only used small metal bowls that I could attempt to crotch.. and I'd never leave things lying around my car like that.... I had a car full of people in it, so I'm assuming it was theirs.

thanks for reading and all, but I really wasnt looking for that...

I was actually wondering if anyone had any thoughts on what might happen or any suggestions....... besides quitting.. cuz that's done.

I beg to differ. I would much prefer that doctors, nurses, airline pilots, and others responsible for maintaining my Earthly existence not be people who smoke five times a day. Marijuana is wonderful stuff. Getting high is fun. From personal experience I also know that it also makes you slow, forgetful, and careless. That's fine when you're hanging out eating Cheetos. It's not so great when you're trying to remember whether or not you gave some patient his injection. "Was that 5 cc or .5 cc?" You should limit your recreational marijuana use to after work so you won't be affected the next day. Either that or stick with a job where other people's lives are not in your hands.

The idea of having a nurse taking care of me who's stoned all the time gives me the willies!

With regards to this thread, it isn't going to go the way you wanted it to, that's for sure. As for your legal case; I am almost sure that the Judge will look at it the same way that Buzzby does.

Methinks you got some trouble ahead.

no I only smoked like that this summer. I dont see anywhere where I wrote that I smoked before work. To GET hired as anything you need a degree for you can count on getting tested, hair tested usually. That's about 3 years away for me, as I'm going to school part time because I have a decent job already. I perform my job and school duties just fine. Just as if someone wouldnt go to school or work after drinking, much less drunk, I dont go to school or work high. I've never had a problem, except for being caught. And I havent smoked since I was arrested on the 8th of July. There's been no huge change in my memory or clearness of thoughts. So maybe it has more of an effect on some people than others. And I never intended to smoke for the rest of my life.. I know some people do, but that's not for me. I'm in college, kids party in college.. then grow up and usually leave certain things behind.

WOW. Totally not what I bargained for.. I thought this was PROpot?

I'm still wondering... does anyone have any idea what happens on a second possession charge in michigan?

We are Pro-Pot...but we are pragmatic to.

Your very best bet is to go to the NORML website which has a list of each state and their penalties for posession etc.

It will be especially important for you as a college student as the Higher Education Act will effectively deny you Student AId if you are convicted.

thankkkkssss I looked at that one already. The only thing I could find is like the maximum penalties. I know I wont get that tho of course. I have a lawyer, but we just haven't met yet. I'm just anxious to find out some info... and my parents have a fat wallet. they pay for my school, along with a couple small scholarships that I receivedd. So that's okay, well not okay but not the worst thing that could happen... I'm just hoping I wont have to go to jail..... or something serious.

Your lawyer will be able to help you best -- s/he will know the local courts and judges and so forth.

One lesson you can take from all this is that everyone is as lucky financially -- Check out Students for a Sensible Drug Policy at your school. Devote some time to the cause of Legalization. Help out so this won't happen to someone who can't afford the problem.

Look, here's the bottom lime: do not smoke in cars! while this may be a hard concept to grasp for people who live with their parents that forbid them to smoke mj, you are 19 and therefore you can get your own apartment. In all the cases i hear about people getting caught, 85% of them have been in a car, 10% happened at school, and the other 5% was when people were at a party that was playing very loud music and the police came and smelled pot. Other rare instances would be like smoking at someone's house when the police show up with a search warrant.

Anyway i think it is appropriate for me to spell out what a drug addict is. A drug addict is a person who is on probation and continues to use while on probation, knowing that if caught by the cops again or failing a drug test, the person spends 30 days in jail and has no hope of getting the charge off his/her record (if 18 or over, of course) for the rest of his/her life. Have you ever considered Narcotics Anonymous? I don't mean to sound arrogent, but i am on probation for MY stupid choice of smoking in a car and havn't smoked mj since the day i was arrested. If i ever smoke mj, it will be when i'm off probation, have a clean background, and will only smoke in my own residence! Also, considering just how heavy of a smoker you were, you must have been smoking a ****load of weed per week.

The third thing i want to point out is that you say that drug possession charges don't really matter when you are getting a job, that is so wrong. even if it's a misdemeanor. I hate to be the bearer of bad news, what i'm trying to tell you is that like someone else said, you really need to listen to exactly what your attourney is telling you.
